These Conditions of Sale apply to any sales of Panerai products or services that you may order from Richemont Suisse S.A., using the website www.panerai.com/ch and any associated mobile or digital applications that refer to these Conditions of Sale (together, the “Platforms”) or by telephone via our client relations center (the “Client Relations Center”).

Richemont Suisse S.A. has its registered offices at 9, route des Biches, 1752 Villars-sur-Glâne, Switzerland (“Panerai” and "we", "us" and "our"). Our VAT number is CHE-102.738.465.

Richemont Suisse S.A. is an affiliate of Terms of Use entity, which owns and edits the Platforms pursuant to the Terms of Use, and Privacy Policy entity, which is responsible for our information collection practices pursuant to the terms of the Privacy Policy. By placing an order, you agree to be bound by the Terms of Use and Privacy Policy, the terms of which are incorporated into these Conditions of Sale.

Please read these Conditions of Sale carefully. These Conditions of Sale are applicable to any order placed through the Platforms or Client Relations Center (together the “Sales Channels”). Please note that before placing an order for products or services, you will be asked to agree to these Conditions of Sale. If you do not agree to these Conditions of Sale, then you will not be able to order any products or services through the Sales Channels. Sales concluded through physical points of sale (such as our retail boutiques) or third parties (such as authorized retailers) are not subject to these Conditions of Sale. 

Updates to these Conditions of Sale

We may make changes from time to time to these Conditions of Sale so please check back regularly to keep informed of updates. The latest version of these Conditions of Sale will always be available on the Platforms. Any new version of these Conditions of Sale shall take effect immediately upon the date of posting and will govern any orders of products or services made as from that date. Any changes to the Conditions of Sale made after you have placed an order will not affect that order and your relationship with us, except as may be required by applicable law.

Purchasing eligibility

Only individuals (and not legal entities) who (a) have reached the age of legal majority required to enter into contracts (eighteen in most countries);  (b) have legal capacity to enter into contracts; and (c) use a shipping address in the country or countries that we ship to (as specified by the Sales Channels), may order products through the Sales Channels. If you are under the age of legal majority or otherwise cannot lawfully enter into a contract, you must have your parent or guardian place an order on your behalf and they will be asked to agree to these Conditions of Sale.

By placing an order through the Sales Channels, you represent and warrant that you are a bona fide end-user customer purchasing for your own or another’s personal use and will not deliver, sell or otherwise distribute our products or purchase our products or services for commercial purposes.

Product availability & quantity

All orders placed through the Sales Channels are subject to availability and acceptance of such orders by us. Products shown on the Platforms, which cannot be added to the shopping bag, are not available for sale via the Platforms. The Client Relations Center can provide more information as regards these products. For information about the order process, please refer to our Order Process section below.

Quantity limits may apply in relation to orders for certain products. We reserve the right to refuse at any moment in time, without prior notice, orders exceeding a certain number of authorized products.

Currently orders may not exceed 4 products (1 watch and 3 accessories) – products in any buying session on the website or through the Client Relations Center.

The Client Relations Center and the product pages of the Website can provide you with information regarding products that are currently available for sale through these channels.

Account registration & guest checkout

To place an order, you may either register and create an online account, or place an order as a guest without creating an online account by selecting the "Guest Checkout" option. Where you place an order as a guest, we may still create an account on our internal systems to record your purchase(s).

Creating an Officine Panerai online account will enable you to save your Wishlist and Comparator lists and access the history of your transactions from the date of creation of your account. 

Personalized services

Personalization services (for example engraving or embossing) or other services may be available on a selection of products. If you wish to have your product personalized, please provide the details in the Sales Channels as requested.

We reserve the right to withhold or refuse acceptance of any order for personalized products, or with a message card, that contains language that is objectionable, unlawful or contrary to our policies. You are responsible for ensuring that any wording you provide for personalizing products is correct.

In addition, orders for personalized products cannot be cancelled and such products that have been personalized in any way or otherwise made to your bespoke specifications cannot be returned to us for exchange or refund, as described in these Conditions of Sale. This does not affect your consumer rights (please see the Manufacturer’s guarantee and your legal consumer rights section below for further information).

Order Process

The order process of the Platforms will include the following:

·            Add to Shopping Bag: Once you have chosen a product, you may place this product in your shopping bag. You may then decide to continue shopping for other products and add them to your shopping bag (subject to availability and quantity limits). Placing an item in your shopping bag does not guarantee availability for purchase, which is not confirmed until you receive a written Confirmation of Order & Shipment.

·            Guest/My Account Checkout: When you are ready, you then proceed to “Checkout”, either as a guest or through your registered account. You may also remove one or several products you have selected from the shopping bag as part of the checkout process. 

·            Delivery, Review and Payment: As part of the checkout process, you add and review your order details and personal information (including e-mail, shipping address, billing address and payment information). You should carefully check and confirm all details on the order summary page before placing your order. 

·            Placing of Order: You then check the relevant box and place your order.

In the case of an order being placed through the Client Relations Center, the Panerai ambassador will walk you through the steps above and verbally ask you to confirm the details of your order.

We reserve the right, in our sole discretion, to refuse, cancel and terminate orders at any time on reasonable grounds. For example, we may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order or if we suspect, in our sole discretion, that you have engaged in (i) fraudulent activities; or (ii) have otherwise violated these Conditions of Sale.  

Prices, taxes and shipping costs

All prices shown on the product pages of the Platforms or quoted by the Client Relations Center are in Swiss Francs (CHF) and include the applicable VAT, but exclude shipping costs and other taxes unless otherwise stated.

Shipping costs, if any, are described in the Shipping Policy below or on the Sales Channels. Shipping costs are not stated on the product pages but will be added to the product price after you have chosen your delivery options. These costs will be summarised before you are asked to confirm and place your order and will also be reflected in our email correspondence with you once you have chosen your delivery options.

We may offer a VAT refund mechanism if you decide to have the products delivered in Switzerland and, no longer than thirty (30) days afterwards, export them outside Switzerland upon certain conditions. For details, please refer to our FAQs section or contact our Client Relations Center.

We reserve the right to modify prices and delivery costs at any time without prior notice.

We take reasonable care that the prices of products and delivery costs are correct at the time when the relevant information was entered into the system or communicated to you via the Client Relations Center. However, it is always possible that, despite our reasonable efforts, some of the products offered through our Sales Channels or delivery costs may be incorrectly priced. If any of the products you place an order for or any delivery costs are incorrectly priced, we will contact you as soon as possible to inform you of this error. If we are unable to contact you using the contact details you have provided during the order process, we will cancel the order and notify you in writing. If we mistakenly accept and process your order where a pricing or delivery cost error occurs, we may cancel supply of the product and refund you any sums you have paid.

Please note that changes to applicable law between the date your order is placed and the date you are sent a written Confirmation of Order & Shipment may result in changes to the taxes associated with your order. If the resulting change is an increase in the taxes that you are charged, we will contact you and ask that you reconfirm your order. 

Payment

We accept the methods of payment identified as part of the order process via the Sales Channels. Depending upon the means of payment, we may require additional information, including specific forms of identification.

When ordering on the Platforms, you will need to enter your payment details on the appropriate form. In the case of an order placed by telephone, you will need to communicate to the Client Relations Center your complete payment details. All payment card holders are subject to validation check and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, you will need to contact your card issuer directly to solve this problem.

 

 

Other payment methods may also be subject to validation checks and authorization by the payment system providers as well. You expressly authorize us to perform security checks, where we deem necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time, including but not limited to your payment card details, to authenticate your identity, to validate your payment card, to obtain an initial payment card authorization and to authorize individual purchase transactions.

The full amount of your purchase will typically be blocked on your payment card until your order is shipped, at which point you will be sent a Confirmation of Order & Shipment and your payment card will be charged the applicable purchase price.

Where we offer PayPal as a payment method, the full amount of your purchase may be debited on your payment card immediately following the placement of your order. Pre-payment shall not impact any of your legal rights under these Conditions of Sale (including for example any right of refund). If we cannot meet our shipping and/or delivery obligations set out below, we will notify you via e-mail and we will refund the pre-payment without undue delay.

We may accept bank wire transfer for orders at our sole discretion. We do not charge a fee for bank wire transfers for orders made through the Sales Channels or Client Relations Centre, however, some financial institutions may charge a fee for using a bank wire transfer. We require that all bank wire transfer orders placed by telephone be confirmed through an order approval process. We may acknowledge a bank wire transfer order, but the order will not be processed until the payment has been received and confirmed by us by e-mail. If your wire transfer payment is not credited into our bank account within seven (7) days after you have placed your order, your order will be cancelled.

Acknowledgement of Order

 

Once you have made your choice and your order has been placed through the Sales Channels, you will receive a written Acknowledgement of Order (by e-mail or otherwise confirming the details of your order together with an order reference number). Please make sure that you save this order reference number for any future enquiries regarding your order. This Acknowledgement of Order is not an acceptance of your order. To confirm the order, we will conduct its usual credit, anti-fraud, security and related legal checks and, if acceptable, will then process your order. Upon receipt of the Acknowledgement of Order, it is your responsibility to review it and confirm that it accurately reflects your intended order. If you have any questions or concerns or if the Acknowledgement of Order does not reflect your intentions, you should contact the Customer Relations Centre promptly. 

These Conditions of Sale will be provided to you when we acknowledge your order.

 

 

Shipping Policy

Upon shipment of your order, we will send you a Confirmation of Order & Shipment in writing (by e-mail or otherwise). This Confirmation of Order & Shipment constitutes our acceptance of your order and indicates the existence of a binding sales contract.

Delivery

We will use reasonable efforts to ensure delivery by the carrier within the estimated delivery lead time from the date of our written Confirmation of Order & Shipment and in any event within thirty (30) days after that date, except if your purchase relates to a product or service that we have explained to you will take additional time to deliver, for example in the case of products or services that we personalize or produce to your specifications. 

When ordering through the Sales Channels, you may be able to choose a specific delivery date as available on the Sales Channels. Any such specific delivery date remains subject to our confirmation.

If delivery of products is delayed by an event outside our control, we will inform you as soon as possible and will use reasonable efforts to minimise the effect of the delay. If we do not deliver within thirty (30) days from the date of the written Confirmation of Order & Shipment or any other time limit as indicated by us, you may contact the Client Relations Center to cancel the relevant order and get a refund of any sums you pre-paid us for any products which you have not received. 

In any event, your sole remedy for any failure by us to deliver the order to you shall be your right to cancel the relevant order and receive a refund of sums you pre-paid us for any products which you have not received.

 

 

When estimating your delivery time, please allow time for credit approval, address verification, security checks and order processing. Please note that delivery is always subject to receiving your full payment.

We will require a handwritten or electronic signature by you, or a person at the nominated delivery address (unless arranged by you otherwise), to confirm the delivery of each product, at which point risk and responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example, as a gift), then you understand and accept that evidence of a signature by such recipient (or a person at the delivery address) is evidence of delivery and fulfilment of the sales contract by Panerai and transfer of responsibility to the recipient in the same way as if the product had been delivered to you. We reserve the right to deliver the products only to the person who is the intended recipient of the order as stated on the label of the parcel and to request ID check for verification purposes at the time of delivery for certain categories of products. Please refer to our FAQs section or call the Client Relations Center for more information.

Invoices

When ordering products via the Sales Channels, you will receive an invoice that will be sent to you in writing (to your e-mail address as a PDF attachment or otherwise). 

Returns and Exchanges

(a)    Right to cancel

You have the right to cancel the contract created by our written order confirmation without giving any reason fourteen (14) days from the day on which you acquire, or someone you nominate (other than the carrier) acquires, physical possession of the products in your order. If you are a customer based in the European Union or the European Economic Area and have made a purchase via the Sales Channels, this is considered to be your statutory right to withdraw from the contract. To meet the withdrawal deadline, it is sufficient for you to withdraw before the withdrawal period has expired.   

To cancel the contract and return your product(s), you can contact our Client Relation Centre and follow the instructions that will be given to you, or send us in writing an unequivocal statement such as a letter or e-mail to: Panerai, Client Relations Centre, RLG Europe BV, PO Box 2967, NL-1000 CZ Amsterdam, or [email protected], you may cancel using the Model Cancellation Form, but it is not obligatory.

(b)   Return Process

Products that have been purchased through the Sales Channels may only be returned to our Panerai e-boutique distribution center at the address of our Returns Department, as provided in our FAQs section.

Products that have not been purchased through the Sales Channels may NOT be returned to our Panerai e-boutique distribution center.

To return a product to our e-boutique distribution center, you must follow the steps mentioned below: 

(i)               Call the Client Relations Center

(ii)              You may either choose (a) our pick up service and agree on a pick-up date with our logistics partner or (b) a parcel drop off at any Swiss Post Office within the return period. You may be asked at this stage to provide information about the product for us to make a first assessment of the condition of this product;

(iii)             In the event you chose parcel drop off at the Swiss Post Office, the Client Relations Center will send you a prepaid return label by e-mail; if you chose our return pick up service, our logistic provider will bring the prepaid return label at the time of pick-up.

(iv)             You must include in the delivery package, the product, along with all its accessories, any free items you received as part of your order, the Service Guide, the Warranty Card and all other documents, in their original box;

(v)              Please seal the delivery package, if applicable, print the prepaid return label and affix it to the parcel; and, depending on the option you chose according to lit (ii) above:

(vi)             On the agreed date, our logistics partner will pick-up the sealed delivery package and give you a return tracking number which you should keep until the order refund confirmation is received or you may drop off the parcel at any Swiss Post Office within the return period, in which case you will be given a receipt with return tracking number which should be kept until order refund confirmation is received.

You must keep a proof of return shipment, and we accept no liability in the event that such proof cannot be produced. Only merchandise received by our Panerai e-boutique distribution center will be eligible for a refund or exchange.

(c)    Condition of Returned Products

We will verify that the returned product satisfies the conditions of the Returns and Exchanges Policy and, if so, then proceed with the applicable refund or exchange.

Our products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original Panerai box and delivery package, including all accessories and documents. For example, timepiece bracelets that have been adjusted at your request must be returned with the exact same number of links as in the original delivery package. We reserve our right not to accept any return if the product shows signs of wear, or has been used or altered from its original condition in any way or, as an alternative, may reduce the amount of any applicable refund or exchange accordingly.

If you have received free items as part of your order, they must be returned with the products.

All returns will be subject to strict Quality Control (QC) by us to ensure that the returned products satisfy these requirements. If the products do not meet QC standards, we will refuse the return, and the products will be sent back to you. If the returned product satisfies QC, we will proceed with the applicable refund or exchange. 

Failure to comply with these Conditions of Sale will entitle us to refuse the returned product and send it back to you, at your own cost.

(d)   Products you cannot return or exchange

Orders for products that have been personalized in any way or otherwise made for you with bespoke specifications cannot be cancelled and such products cannot be returned to us for exchange or refund.

(e)    Refunds

You may return a product purchased through the Sales Channels for refund, provided that the return complies with these Conditions of Sale, in particular with (a) Right to Cancel and (b) Return Process above.

Only the buyer will be entitled to receive a refund of the purchase price. In no event will a person who has received the product as a gift (i.e. a “Gift Recipient”) be entitled to receive a refund. If you are a Gift Recipient and wish to return a product, please contact the Client Relations Center to discuss your options.

If the return complies with these Conditions of Sale, we will use commercially reasonable endeavours to refund the purchase price to the buyer using the same means of payment as used by the buyer for the initial transaction within fourteen (14) days after receipt of the returned item by the Panerai e-boutique distribution center. Except for delivery of a defective product by us, initial shipping charges will not be refunded.

(f)     Exchanges

You may return a product purchased through the Sales Channels for exchange with another Panerai product, provided that the return complies with these Conditions of Sale in particular with (a) Right to Cancel and (b) Return Process above.

In any event, the sale of the returned product will be cancelled and a new order for the product ordered must be placed.

Should a product be returned to the Panerai e-boutique distribution center for exchange with a less expensive product, only the buyer of the returned product will be entitled to receive a refund of the price difference.

If a product is returned for exchange with a more expensive product, you will have to pay the price difference. 

Manufacturer’s guarantee and your legal consumer rights

We are committed to ensuring that each product strictly complies with our quality criteria and that it has passed all our controls, both technical and aesthetic.

Selected products are covered by the applicable Panerai Guarantee. If you wish to repair a product covered by the applicable Panerai Guarantee, please refer to the applicable Panerai Guarantee, and call our Client Relations Center for more information.

In your capacity as consumer, you may have legal rights under the applicable law of governing the sale of consumer goods; those legal rights are not affected by these Conditions of Sale or the applicable Panerai Guarantee.

Complimentary Services

The following complimentary services will be proposed, free of charge, by the Sales Channels:

(a)  Gift Wrap and Packaging

All orders will be shipped with the Panerai box gift wrapped in Panerai special packaging, together with a Panerai shopping bag (where applicable).

Orders for personalized Panerai products cannot be cancelled and personalized Panerai products cannot be returned to Panerai for exchange or refund.

 (b)  Strap Exchange / Adjustment

A Panerai watch strap is delivered in a standard size. For certain products, the strap size can be delivered smaller or larger. If available, please specify your requirements on the Platforms or by calling the Client Relations Center. Panerai watch strap adjustment is also available on certain watch models. If you request a watch bracelet adjustment, the removed links will be returned to you and included in the delivery package.

(c)  Gift Note

You may be able to personalize your order by adding a personalized note that will be printed by Panerai on a gift card to be included in your order package. Panerai reserves the right to reject gift card notes it deems offensive or inappropriate to be sent on Panerai-logo stationery.

Repairs

For any repair inquiries relating to a product ordered through the Sales Channels, please refer to our FAQs section or contact our Client Relations Center.

Product descriptions

We try to ensure that the information, including product descriptions, dimensions, and colours, provided on the Platforms, in advertisements or catalogues or as provided by the Client Relations Center is accurate and complete. However, we make no guarantees, whether express or implied, in relation to the accuracy, reliability and completeness of such information. 

Limitation of liability

If any provision, or part of a provision, of these Conditions of Sale is found to be illegal, invalid or unenforceable, that provision or part-provision shall be deemed not to form part of these Conditions of Sale, and the legality, validity or enforceability of the remainder of the provisions of these Conditions of Sale shall not be affected, unless otherwise required by operation of applicable law.

These Conditions of Sale (and associated terms incorporated by reference) constitute the entire agreement between you and us in relation to the order of products or services, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature made by the parties, whether oral or written, in relation to such subject matter.

We are not responsible for any failure or delay in performing or complying with our obligations under these Conditions of Sale which arises from any cause beyond our reasonable control.

The waiver by us of a breach of any provision of these Conditions of Sale will not operate to be interpreted as a waiver of any other or subsequent breach.

This contract is between us and you. No other person shall have any rights to enforce any of its terms. However, if you purchase a product as a gift, the recipient of your gift will have the benefit of the applicable Panerai Guarantee.

General provisions

If any provision, or part of a provision, of these Conditions of Sale is found to be illegal, invalid or unenforceable, that provision or part-provision shall be deemed not to form part of these Conditions of Sale, and the legality, validity or enforceability of the remainder of the provisions of these Conditions of Sale shall not be affected, unless otherwise required by operation of applicable law.

These Conditions of Sale (and associated terms incorporated by reference) constitute the entire agreement between you and us in relation to the order of products or services, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature made by the parties, whether oral or written, in relation to such subject matter.

We are not responsible for any failure or delay in performing or complying with our obligations under these Conditions of Sale which arises from any cause beyond our reasonable control.

The waiver by us of a breach of any provision of these Conditions of Sale will not operate to be interpreted as a waiver of any other or subsequent breach.

This contract is between us and you. No other person shall have any rights to enforce any of its terms. However, if you purchase a product as a gift, the recipient of your gift will have the benefit of the applicable Panerai Guarantee.

Applicable law and jurisdiction

These Conditions of Sale shall be governed by and construed in accordance with the laws of Switzerland without reference to conflict of laws provisions. Any dispute, controversy or claim arising out of or in relation to the Conditions of Sale, including the validity, invalidity, breach or termination of the Conditions of Sale, shall be adjudicated or arbitrated in accordance with the Conditions of Sale.  Where the laws of Switzerland are different to the mandatory consumer laws in your own country, we will afford you with similar protection.

You may bring proceedings against us either in the courts of Fribourg or in the country where you are domiciled. We may also bring proceedings against you in the courts of the country where you are domiciled.

Without any restriction to bring proceedings before a court, you and Panerai will first make reasonable efforts for a period of thirty (30) days to resolve amicably any dispute or failure to agree that may arise out of or relate to the product, the Conditions of Sale or any breach thereof.

If you are a consumer resident in the European Union, you have the right to submit your complaint to an Alternative Dispute Resolution entity. تنتسب هيئة البيع إلى شروط الاستخدام، وتمتلك المنصات وتعدّلها وفقًا لشروط الاستخدام وسياسة الخصوصية وتضطلع بمسؤولية الإشراف على ممارساتنا في جمع المعلومات بمقتضى أحكام سياسة الخصوصية. عند تقديم طلبية، توافقون على الامتثال لشروط الاستخدام وسياسية الخصوصية التي تندرج أحكامها في شروط البيع هذه.

يرجى قراءة شروط البيع هذه بإمعان. تنطبق شروط البيع هذه على كل الطلبيات المقدّمة عبر المنصات أو مركز العلاقات مع العملاء (يُشار إليها جميعًا بعبارة "قنوات البيع"). يرجى الانتباه إلى ضرورة الموافقة على شروط البيع هذه قبل تقديم طلبية منتجات أو خدمات. إذا لم توافقوا على شروط البيع هذه، فلن يتسنى لكم طلب منتجات أو خدمات عن طريق قنوات البيع. لا تخضع عمليات البيع المبرمة في نقاط البيع (مثل متاجر بيع التجزئة) أو مع أطراف ثالثة (مثل وكلاء بيع التجزئة المعتمدين) لشروط البيع هذه. 

مستجدات شروط البيع هذه

يقتصر طلب شراء المنتجات عبر قنوات البيع على الأفراد (وليس الكيانات القانونية) الذين (أ) بلغوا سن الرشد القانوني المطلوب لإبرام العقود (ثمانية عشر عامًا في معظم البلدان)، (ب) لديهم الأهلية القانونية لإبرام العقود، (ج) يستخدمون عنوان توصيل في البلد أو البلدان التي نشحن إليها منتجاتنا على النحو المشار إليه في قنوات البيع. إذا لم تبلغوا سن الرشد القانوني أو لا تملكون الأهليّة القانونية لإبرام العقود، يجب أن تطلبوا من آبائكم أو من وصيّكم تقديم الطلبية نيابة عنكم وسيُطلب منهم الموافقة على شروط البيع هذه.

عند تقديم طلبية عبر قنوات البيع، تصرّحون وتؤكدون بأنكم عملاء مستخدمون نهائيون تشترون عن حسن نية لاستخدام شخصي أو استخدام طرف ثالث وأنكم لن تبيعوا منتجاتنا ولن توزعوها ولن تشتروا منتجاتنا أو خدماتنا لأغراض تجارية.

الأهلية للشراء

تخضع كل الطلبيات المقدّمة عبر قنوات البيع لشروط توفرها وقبولنا لهذه الطلبيات. المنتجات التي ترد على المنصة والتي لا يمكن إضافتها إلى حقيبة التسوّق غير متاحة للبيع عبر المنصات. يمكن أن يقدّم لكم مركز العلاقات مع العملاء المزيد من المعلومات عن هذه المنتجات. للحصول على المزيد من المعلومات عن عملية تقديم الطلبية، يرجى الرجوع إلى قسم عملية تقديم الطلبية الوارد أدناه.

قد ينطبق مبدأ حدود الكمية على طلبيات بعض المنتجات. نحتفظ بالحق في رفض الطلبيات التي تتجاوز عددًا معينًا من المنتجات المصرح بها في أي وقت وبدون إشعار مسبق.

لا يجوز أن تتجاوز الطلبيات 4 منتجات (ساعة و3 لوازم) في الوقت الراهن، وهي المنتجات التي يمكن شراؤها في معاملة شراء واحدة على الموقع الإلكتروني أو عبر مركز العلاقات مع العملاء.

يقدّم لكم مركز العلاقات مع العملاء وصفحات الموقع الإلكتروني للمنتجات معلومات عن المنتجات المتاحة حاليًا للبيع عبر هذه القنوات.

توفر المنتج وكميته

تخضع كل الطلبيات المقدّمة عبر قنوات البيع لشروط توفرها وقبولنا لهذه الطلبيات. المنتجات التي ترد على المنصة والتي لا يمكن إضافتها إلى حقيبة التسوّق غير متاحة للبيع عبر المنصات. يمكن أن يقدّم لكم مركز العلاقات مع العملاء المزيد من المعلومات عن هذه المنتجات. للحصول على المزيد من المعلومات عن عملية تقديم الطلبية، يرجى الرجوع إلى قسم عملية تقديم الطلبية الوارد أدناه.

تسجيل حساب والدفع دون تسجيل

لتقديم طلبية، يجوز لكم التسجيل وإنشاء حساب إلكتروني أو تقديم الطلبية دون تسجيل حساب إلكتروني بتحديد خيار "الدفع دون تسجيل حساب". عند تقديم طلبية دون تسجيل حساب، قد نسجل حسابًا على أنظمتنا الداخلية لتسجيل عملية شرائكم.

يتيح لكم إنشاء حساب بانيراي الإلكتروني حفظ لائحة رغباتكم وقوائم المقارنة والوصول إلى أنشطتكم السابقة ومعاملاتكم منذ تاريخ إنشاء الحساب. 

خدمات شخصية

قد تتوفر خدمات إضفاء الطابع الشخصي (مثل الحفر والنقش) أو غيرها من الخدمات لمجموعة مختارة من المنتجات. إذا أردتم إضفاء طابع شخصي على منتجكم، فيرجى تقديم التفاصيل في قنوات البيع على النحو المطلوب.

نحتفظ بالحق في عدم قبول أو رفض قبول أيّة طلبية منتجات تكتسي طابعًا شخصيًا أو مصحوبة ببطاقة هدية بلغة ذميمة أو غير قانونية أو مخالفة لسياساتنا. تتحملون مسؤولية صحة أي عبارة تقدّمونها لإضفاء طابع شخصي على المنتجات.

بالإضافة إلى ذلك، لا يمكن إلغاء طلبيات المنتجات التي تكتسي طابعًا شخصيًا ولا يمكن إرجاع أو استبدال أو تعويض المنتجات التي أُضفيَ عليها طابع شخصي بأي شكل من الأشكال وفقًا لمواصفاتكم على النحو المبيّن في شروط البيع هذه. لا يؤثر هذا الأمر في حقوق المستهلك القانونية (يرجى الاطلاع على قسم ضمان المصنّع وحقوق المستهلك القانونية للحصول على المزيد من المعلومات).

عملية تقديم الطلبية

تنطوي عملية تقديم الطلبية في المنصات على العناصر الآتية:

·            الإضافة إلى حقيبة التسوّق: بعد اختيار منتج، يجوز لكم وضع هذا المنتج في حقيبة تسوّقكم. ثم يجوز لكم أن تقرّروا متابعة اختيار منتجات أخرى وإضافتها إلى حقيبة التسوّق (شريطة توفرها في حدود الكمية المتاحة). وضع منتج في حقيبة التسوّق لا يضمن توفره للشراء الذي لن يتأكد إلّا بعد استلام تأكيد خطي للطلبية والشحن.

·            الدفع باستخدام حسابي أو دون تسجيل حساب: عندما تفرغون من الاختيار، تنتقلون إلى مرحلة "الدفع" دون تسجيل حساب أو عن طريق حسابكم المسجل. يجوز لكم أيضًا أن تسحبوا منتجًا أو عدّة منتجات اخترتموها من حقيبة التسوّق عند عملية الدفع. 

·            التوصيل والاستعراض والدفع: في إطار عملية الدفع، تضيفون تفاصيل طلبيّتكم والمعلومات الشخصية (ولا سيما عنوان البريد الإلكتروني وعنوان التوصيل عنوان إرسال الفاتورة ومعلومات الدفع) وتتحققون منها. يجب أن تتحققوا بعناية من كل التفاصيل الواردة على صفحة المعلومات الموجزة للطلبية قبل تقديم الطلبية. 

·            تقديم الطلبية: تضعون بعد ذلك علامة في الخانة المناسبة وتقدمون الطلب.

في حال تقديم طلبية عبر مركز العلاقات مع العملاء، يرشدكم سفير بانيراي لإتمام الخطوات الواردة أعلاه ويطلب منكم شفهيًا تأكيد تفاصيل الطلبية.

نحتفظ بالحق، حسب تقديرنا الخاص، في رفض أيّة طلبية وإلغائها ووقفها في أيّ وقت لأسباب معقولة. على سبيل المثال، يجوز لنا رفض طلبيتكم أو وقفها أو إلغاؤها إذا كان هناك نزاع قائم بشأن دفع قيمة طلبية سابقة أو إذا اعتقدنا، وفقًا لتقديرنا الخاص، بأنكم قد انخرطتم في (1) أنشطة احتيالية أو (2) انتهكتم بطريقة أخرى شروط البيع هذه.  

الأسعار والضرائب وتكاليف الشحن

كل الأسعار التي تشير إليها المنصات على صفحاتها أو التي يذكرها مركز العلاقات مع العملاء مشمولة بضرائب البيع أو ضريبة القيمة المضافة ولكنها تستثني تكاليف الشحن وغيرها من الضرائب ما لم يُذكر خلاف ذلك.

سيجري تحديث العملة المعمول بها استنادًا إلى وجهة الشحن بعد أن تزوّدونا بعنوان التوصيل وسيُشار إليها في حقيبة تسوّقكم قبل أن تقدّموا الطلب. يجب عليكم التحقق بعناية من تحديث الأسعار والعملات.

تتفاوت ضرائب المبيعات أو الانتفاع أو غيرها من الضرائب بناءً على المكان الذي تُشحن المنتجات إليه.

يرد وصف تكاليف الشحن عند الاقتضاء في سياسة الشحن أدناه أو في قنوات البيع. لا تُذكر تكاليف الشحن في صفحات المنتجات، ولكن تُضاف إلى سعر المنتج بعد تحديد خيارات التوصيل. سيرد موجز لهذه التكاليف قبل أن يُطلب منكم تأكيدها وتقديم طلبيّتكم وستظهر أيضًا في بريدنا الإلكتروني الذي نرسله لكم بعد تحديد خيارات التوصيل.

قد نقترح عليكم طريقة تعويض ضريبة القيمة المضاف إذا قررتم أن تستلموا منتجاتكم في بعض بلدان الاتحاد الأوروبي وأن تصدّروها خارج الاتحاد الأوروبي في غضون مدة لا يتجاوز حدّها الأقصى ثلاثين (30) يومًا بعد ذلك رهنًا بشروط معيّنة. لا تنطبق هذه الطريقة على العملاء المقيمين في منطقة الاتحاد الأوروبي. للحصول على المزيد من التفاصيل، يرجى الاطلاع على قسم الأسئلة الشائعة أو الاتصال بمركز العلاقات مع العملاء التابع لنا.

نحتفظ بالحق في تعديل الأسعار وتكاليف التوصيل في أي وقت دون إشعار مسبق.

نحرص قدر المستطاع على أن تظل أسعار منتجاتنا وتكاليف التوصيل صحيحة حين تُدوّن المعلومات الهامة في النظام أو عندما يعلمكم بها مركز العلاقات مع العملاء التابع لنا. لكن من المحتمل دائمًا أن يعتري الخطأ أسعار بعض المنتجات المقترحة في قنوات البيع أو تكاليف التوصيل بالرغم من الجهود المعقولة التي نبذلها. إذا ورد خطأ في سعر أحد المنتجات المطلوبة أو تكاليف التوصيل، فسنتصل بكم في أقرب الآجال لنبلغكم بهذا الخطأ. إذا لم يتسن لنا الاتصال بكم باستخدام بيانات الاتصال التي زوّدتمونا بها خلال عملية تقديم الطلبية، نلغي الطلبية ونرسل لكم إشعارًا خطيًا. إذا أخطأنا ووافقنا على طلبيتكم التي يعتري سعرها أو تكاليف توصيلها خطأ، فيجوز لنا أن نلغي تزويدكم بالمنتج ونردّ لكم المبالغ المدفوعة.

يرجى ملاحظة أن التغييرات التي تطرأ على القانون المعمول به بين تاريخ تقديم الطلبية وتاريخ استلام التأكيد الخطي للطلبية والشحن قد تؤدي إلى تغيّر الضرائب المرتبطة بطلبيتكم. إذا أدى التغيير الناتج إلى زيادة في الضرائب التي يجري تحصيلها منكم، فسوف نتواصل معكم ونطلب منكم إعادة تأكيد الطلبية. 

الدفع

نقبل وسائل الدفع المحدّدة في إطار عملية تقديم الطلبية عبر قنوات البيع. استنادًا إلى وسيلة الدفع، يجوز لنا أن نطلب منكم تقديم معلومات إضافية، ولا سيما وثائق معيّنة لتحديد الهوية.

عند تقديم الطلبية على المنصات، ستضطرون إلى إدخال بيانات الدفع الخاصة بكم في النموذج المناسب. إذا قدّمتم طلبية عبر الهاتف، فيجب عليكم أن تزوّدوا مركز العلاقات مع العملاء ببيانات الدفع الكاملة. يخضع جميع حاملي بطاقات الدفع للتحقق من الصلاحية والتفويض لدى جهة إصدار البطاقة. إذا رفضت جهة إصدار بطاقة الدفع أن تأذن بالدفع لنا، فستضطرون إلى التواصل مع جهة إصدار البطاقة مباشرةً لحل هذه المشكلة.

قد تخضع بعض وسائل الدفع الأخرى أيضًا لعمليات تحقّق وطلب أذونات لدى الجهات المقدّمة لخدمات الدفع. تخولون لنا صراحةً حق إجراء عمليات مراقبة أمنية، حيثما نرى أنها ضرورية، ونقل معلومات عنكم (بما في ذلك أي معلومات محدثة) إلى أطراف ثالثة أو طلبها من تلك الأطراف من وقت لآخر، بما في ذلك، على سبيل المثال لا الحصر، تفاصيل بطاقة الدفع للمصادقة على الهوية والتحقق من صلاحية بطاقة الدفع والحصول على تفويض مبدئي على بطاقة الدفع ولتفويض معاملات الشراء الفردية.

سيجري حجز القيمة الكاملة لمشترياتكم في بطاقة الدفع حتى تُشحن طلبيتكم، وفي هذه المرحلة سيُرسل تأكيد الطلبية وشحنها وحينها يجري تحصيل سعر الشراء المطبق من بطاقة الدفع.

أما عندما نقترح خدمة باي بال، فقد يُقتطع مبلغ مشترياتكم الإجمالي من بطاقة الدفع فور تقديم الطلبية. لن يؤثر الدفع المسبق في أي من حق من حقوقكم القانونية التي تنص عليها شروط البيع هذه (بما في ذلك، على سبيل المثال، أي حق في استرداد المبالغ المدفوعة). إذا لم نتمكن من الوفاء بالتزاماتنا الخاصة بالشحن و/أو التوصيل الموضحة أدناه ، فسنخطركم عبر البريد الإلكتروني وسنرد لكم الدفعة المقدمة دون أي تأخير لا مبرر له.

يجوز لنا أن نقبل التحويلات البرقية لدفع مبالغ الطلبيات وفقًا لتقديرنا الخاص. لا نفرض تكاليف على التحويلات البرقية بالنسبة إلى الطلبيات المقدّمة عبر قنوات البيع أو مركز العلاقات مع العملاء، ولكن بعض المؤسسات المصرفية قد تفرض تكاليف على استخدام التحويل البرقي. يجب تأكيد كل طلبيات التحويل البرقي المقدّمة عبر الهاتف بعملية الموافقة على الطلبيات. يجوز لنا أن نقرّ باستلام طلبية عبر التحويل البرقي ولكن الطلبية لن تُعَالَج ما لم نستلم المبلغ ولم نؤكد استلامه عبر البريد الإلكتروني. إذا لم يُقَيَّد مبلغكم المدفوع بالتحويل البرقي في حساب مصرفنا خلال سبعة (7) أيام بعد تقديم الطلبية، فستُلغى طلبيتكم.

إقرار الطلبية

بعد تحديد خياركم وتقديم طلبيتكم عبر قنوات البيع، تستلمون إقرارًا خطيًا نؤكد فيه استلام الطلبية (عبر البريد الإلكتروني أو غيره لتأكيد تفاصيل طلبيتكم إلى جانب رقم الطلبيّة المرجعي). يرجى حفظ رقم الطلبية المرجعي لأيّ طلب لاحق متعلق بطلبيتكم. لا يمثل إقرار الطلبية هذا قبولًا للطلبية. لتأكيد الطلبية، سنُجري عمليات التحقق من صلاحية بطاقة الائتمان وفحوص مكافحة الاحتيال والأمان والفحوص القانونية ذات الصلة المعتادة، وتُعالَج طلبيتكم لدى قبولها. أنتم ملزمون بالتحقّق من إقرار الطلبية بعد استلامه والتأكد من أنه يعكس تمامًا الطلبية المقدّمة.  إذا كانت لديكم أسئلة أو استفسارات أو إذا لم يؤكد إقرار استلام الطلبية تصريحاتكم، فيجب الاتصال بمركز العلاقات مع العملاء في أسرع وقت. 

سنرسل لكم شروط البيع هذه عندما نقر باستلام طلبيتكم.

سياسة الشحن

يقتصر قبولنا على الطلبيات التي ينبغي توصيلها إلى البلد أو البلدان المحدّدة في عملية تقديم الطلبية. يرجى الانتباه إلى أننا لا نشحن إلى بعض العناوين، كالعناوين العسكرية وبعض المناطق المحظورة ونقاط التقاط الشحنة أو صناديق البريد. للحصول على المزيد من المعلومات، يرجى الاطلاع على قسم الأسئلة الشائعة أو الاتصال بمركز العلاقات مع العملاء.

يجوز الاستفادة من خدمة التقاط الشحنة في المتجر مجانًا في بعض الأماكن. يرجى الاطلاع على قسم الأسئلة الشائعة أو الاتصال بمركز العلاقات مع العملاء للحصول على المزيد من المعلومات. سنبلغكم عبر البريد الإلكتروني أو الهاتف عندما يصبح المنتج جاهزًا لالتقاطه في المتجر.

في حال طلبتم العديد من المنتجات، فلن نشحن الطلبية إلا بعد توفر جميع المنتجات (لن نرسل شحنات جزئية ما لم نخبركم بخلاف ذلك). 

تأكيد الطلبية والشحن

عند بلوغ مرحلة شحن طلبيتكم، نرسل لكم تأكيد الطلبية والشحن خطيًا (عبر البريد الإلكتروني أو غيره). يشكّل تأكيد الطلبية والشحن هذا قبولنا لطلبيتكم ويشير إلى وجود عقد بيع مُلْزِم. 

التوصيل

سنبذل جهودًا معقولة لضمان التوصيل عبر شركة النقل في أجل التوصيل التقديري ابتداءً من تاريخ تأكيد الطلبية والشحن خطيًا على كل حال في غضون ثلاثين (30) يومًا بعد هذا التاريخ، إلّا إذا تعلّقت مشترياتكم بمنتج أو خدمة شرحنا لكم أن توصيلها سيستغرق المزيد من الوقت، مثل المنتجات أو الخدمات التي نضفي عليها طابعًا شخصيًا أو نصنعها استنادًا إلى الأوصاف التي قدّمتموها.

عندما تقدمون طلبية عبر قنوات البيع، يجوز لكم اختيار تاريخ توصيل معيّن متاح على قنوات البيع. سيخضع أي تاريخ توصيل محدّد لتأكيدنا.

إذا تأخر توصيل منتجات بسبب أحداث خارجة عن سيطرتنا، فسنخبركم في أسرع وقت ممكن وسنبذل جهودًا معقولة لتقليص العواقب المترتبة على هذا التأخير. إذا لم نعمل على توصيل المنتج في غضون ثلاثين (30) يومًا ابتداءً من تاريخ تأكيد الطلبية والشحن خطيًا أو في غضون أيّ أجل آخر أشرنا إليه، فيجوز لكم الاتصال بمركز العلاقات مع العملاء لإلغاء الطلبية المعنية واسترداد المبالغ المدفوعة للمنتجات التي لم تستلموها. 

على كل حال، إذا قصرنا في توصيل الطلبية، فالحل الوحيد يكمن في ممارسة حقكم في إلغاء الطلبية واسترداد المبالغ المدفوعة مسبقًا لكل المنتجات التي لم تستلموها.

عند تقدير مدة التوصيل، يرجى إتاحة الوقت للموافقة على بطاقة الائتمان والتحقق من العنوان والفحوص الأمنية ومعالجة الطلبية. ويرجى ملاحظة أن التوصيل مرهون دائمًا بتلقي قيمة الطلبية كاملة.

سنطلب منكم أو من شخص آخر موجود في عنوان التوصيل المحدّد (ما لم تطلبوا منا خلاف ذلك) توقيعًا خطيًا أو إلكترونيًا، لتأكيد تسليم كل منتج، وعندها تتحملون مسؤولية مشترياتكم والمخاطر المحتملة. إذا عيّنتم شخصًا غيركم لاستلام المنتج (مثل هدية)، تقرون وتوافقون على أن دليل توقيع هذا الشخص (أو شخص آخر موجود في عنوان التوصيل) يشكّل دليل توصيل وتنفيذ بانيراي للعقد ونقل المسؤولية إلى المستلم بالطريقة نفسها إذا جرى توصيل المنتج إليكم. نحتفظ بالحق في توصيل المنتجات فقط للأشخاص الذين عُيّنوا لاستلام الطلبية على النحو المشار إليه على بطاقة الطرد وفي طلب مراقبة الهوية لأغراض التحقق عند التوصيل فيما يتعلق ببعض فئات المنتجات. يرجى الاطلاع على قسم الأسئلة الشائعة أو الاتصال بمركز العلاقات مع العملاء التابع لنا للحصول على المزيد من المعلومات.

الفواتير

عند طلب المنتجات عبر قنوات البيع، ستتلقون فاتورة تُرسل إليكم كتابيًا (إلى عنوان بريدكم البريد الإلكتروني في صورة مرفق بصيغة pdf أو غير ذلك). 

الإرجاع والاستبدال

(أ)   الحق في الإلغاء

يحق لكم إلغاء العقد المكتتب بتأكيد الطلبية خطيًا دون إبداء أيّ مبرّر في غضون أربعة عشر (14) يومًا ابتداءً من يوم استلامكم، أو استلام الشخص الذي تعيّنونه (غير موظّف شركة النقل)، منتجات طلبيّتكم فعليًا. إذا كنتم عملاء مقيمين في الاتحاد الأوروبي أو المنطقة الاقتصادية الأوروبية واشتريتم منتجات عبر قنوات البيع، فمن حقكم القانوني إلغاء العقد. لمراعاة أجل الانسحاب، يكفي أن تنسحبوا قبل انقضاء أجل الانسحاب.   

لإلغاء العقد وإرجاع المنتج أو المنتجات، يمكنكم الاتصال بمركز العلاقات مع العملاء واتباع الإرشادات التي تُقدّم لكم أو يمكنكم أن ترسلوا بيانًا خطيًا لا لبس فيه، مثل رسالة أو بريد إلكتروني إلى العنوان التالي: Panerai, RLG Europe BV, PO Box 2967, NL-1000 CZ Amsterdam أو [email protected] يجوز لكم أيضًا أن تلغوا العقد باستخدام استمارة الإلغاء ولكن هذا الخيار غير إجباري.

(ب)   عملية الإرجاع

تُرجَع المنتجات التي اشتُريت عبر قنوات البيع لمركز التوزيع التابع لمتجر بانيراي الإلكتروني فقط بعنوان القسم المعني بإرجاع المنتجات على النحو الذي بيّنه مركز العلاقات مع العملاء التابع لنا في قسم الأسئلة الشائعة أو لمتاجر بيع التجزئة التابعة لبانيراي إذا كانت متاحة وفقًا لشروط البيع هذه.

لا يجوز إرجاع المنتجات التي لم تُشترى عبر قنوات البيع لمركز التوزيع التابع لمتجرنا الإلكتروني.

لإرجاع منتج ما إلى مركز التوزيع التابع لمتجرنا الإلكتروني، يجب عليكم اتباع الخطوات المشار إليها أدناه: 

(1)              اتصلوا بمركز العلاقات مع العملاء.

(2)             يجوز لكم اختيار (أ) استخدام خدمة التقاط الشحنة في المتجر وتحديد تاريخ مع شريكنا المكلّف بالنقل والإمداد لأخذ المنتج أو (ب) إيداع الشحنة في موقع من مواقع شبكة شريكنا المكلّف بالنقل والإمداد خلال فترة الإرجاع المنصوص عليها. قد يُطلب منكم تقديم معلومات عن المنتج في هذه المرحلة حتى يتسنى لنا إجراء تقييم أولي لحالة المنتج.

(3)            سيرسل لكم مركز العلاقات مع العملاء استمارة الإرجاع عبر البريد الإلكتروني أو سيطلب منكم ملء استمارة الإرجاع المرفقة بطلبيتكم حين توصيلها.

(4)            يرجى تدوين المعلومات المطلوبة على استمارة الإرجاع وتوقيعها.

(5)             يجب أن تضعوا في الطرد استمارة الإرجاع المملوءة حسب الأصول وأن تضعوا المنتج وكل اللوازم وأي منتجات مجانية استلمتموها في إطار طلبيتكم ودليل الصيانة وبطاقة الضمان وكل الوثائق الأخرى، في الصندوق الأصلي.

(6)            يرجى إغلاق الطرد بإحكام ووضع بوليصة الشحن الجوي المستلمة مع مشترياتكم.

(7)           في التاريخ المتفق عليه، يأتي شريكنا المكلّف بالنقل والإمداد لالتقاط الطرد المغلق بإحكام أو تختارون خدمة إيداعه في أحد مواقع شبكة شريكنا المكلّف بالنقل والإمداد، وفي هذه الحال تستلمون إيصالاً يحمل رقم تعقّب المنتج المرتجع ويجب الاحتفاظ به حتى نرسل لكم تأكيد تعويض الطلبية عبر البريد الإلكتروني.

يجب الاحتفاظ بدليل شحن المنتج المرتجع ولن نقبل أيّة مسؤولية إذا لم يُقدّم هذا الدليل. يقتصر التعويض والاستبدال على المنتجات التي استلمها مركز التوزيع التابع لمتجر بانيراي الإلكتروني.

يجوز لكم إرجاع المنتج في متجر من متاجر بانيراي في البلد الذي سُلّم فيه إذا تسنى ذلك. يرجى الاتصال بمركز العلاقات مع العملاء للحصول على المزيد من التفاصيل. قد يُطلب منكم تقديم معلومات عن المنتجات حتى نتمكن من إجراء تقييم أولي لحالة هذه المنتجات.

(ج)   حالة المنتجات المرتجعة

سنتحقق من أن المنتج المرتجع يستوفي شروط سياسة الإرجاع والاستبدال، وإذا استوفاها، فسنتابع عملية استرداد المبلغ المدفوع أو الاستبدال بالأسلوب المعمول به.

يجب إرجاع منتجاتنا في حالة جديدة وغير مستخدمة، وفي حالة ممتازة، إلى جانب جميع المواد الواقية والعلامات والملصقات (إن وُجدت)، وصندوقنا الأصلي وطرد التوصيل، بما في ذلك جميع الملحقات والمستندات. على سبيل المثال، يجب إرجاع أساور الساعة التي تم تعديلها بناءً على طلبكم بنفس عدد الوصلات المستلمة في طرد التوصيل الأصلي. نحتفظ بالحق في عدم قبول المنتج المرتجع إذا بدت عليه علامات تقادم أو إذا استُخدم أو عُدّل مقارنة بحالته الأصلية بأيّ شكل من الأشكال. وبناءً عليه، يجوز لنا أيضًا تخفيض مبلغ التعويض أو الاستبدال.

إذا كنتم قد تلقيتم عناصر مجانية كجزء من طلبيتكم، فيجب إعادتها مع المنتجات.

نُخضع جميع المنتجات المرتجعة لرقابة صارمة على الجودة (QC) للتأكد من أن المنتجات المرتجعة تفي بهذه المتطلبات. إذا كانت المنتجات لا تفي بمعايير مراقبة الجودة، فسوف نرفض عملية الإرجاع، وسنُرجع المنتجات إليكم مرة أخرى. أما إذا كان المنتج المرتجع يستوفي معايير مراقبة الجودة، فسنتابع عملية التعويض أو الاستبدال. 

يخوّل لنا عدم الامتثال لشروط البيع هذه الحق في رفض المنتج المرتجع وإرساله إليكم مرة أخرى على نفقتكم الخاصة.

(د)   المنتجات التي لا يمكنكم إرجاعها أو استبدالها

لا يمكن إلغاء طلبيات المنتجات التي اكتست طابعًا شخصيًا بأيّ شكل من الأشكال أو صُنعت لكم وفقًا لمواصفات خاصة لا يمكن إلغاؤها ولا يمكن إرجاع هذه المنتجات لاستبدالها أو استرداد الأموال.

(هـ)   عمليات استرداد الأموال

يجوز لكم إرجاع منتج اشتريتموه عبر قنوات البيع للحصول على تعويض المبلغ المدفوع شريطة أن يمتثل المنتج المرتجع لشروط البيع هذه، ولا سيما البندين (أ) حق الإلغاء و(ب) عملية الإرجاع الواردين أعلاه.

يحق للمشتري فقط استرداد قيمة المشتريات. لن يحق لأي شخص تلقى المنتج كهدية (أي "مستلم الهدية") استرداد قيمة المنتج بأي حال من الأحوال. إذا كنتم مستلمي الهدية ورغبتم في إرجاع المنتج، يرجى الاتصال بمركز العلاقات مع العملاء لتباحث الخيارات المتاحة.

إذا كان الإرجاع يتوافق مع شروط البيع هذه، فسنبذل جهودًا معقولة تجاريًا لرد قيمة المشتريات إلى المشتري باستخدام وسائل الدفع نفسها التي استخدمها المشتري في صفقة الشراء الأولية في غضون أربعة عشر (14) يومًا بعد أن يستلم مركز التوزيع التابع لمتجر بانيراي الإلكتروني المنتج المرتجع. لا يمكن استرداد تكاليف الشحن الأولية إلّا إذا كان المنتج الذي قمنا بتوصيله تالفًا.

إذا أرجعتم منتجًا اشتريتموه عبر قنوات البيع في متجر من متاجر تجزئة بانيراي المشاركة (يرجى الاتصال بمركز العلاقات مع العملاء لمعرفة متاجر تجزئة بانيراي المشاركة)، فلن يحق لكم إلّا استلام رصيد بقيمة المنتج في المتجر. لن تحصلوا على أيّ تعويض نقدي أو بالبطاقة لمنتج مرتجع في متجر من متاجر تجزئة بانيراي المشاركة. لا يمكن أن تنطبق أرصدة الشراء من المتجر إلّا على المنتجات التي تشترونها في متجر من متاجر تجزئة بانيراي المشاركة ولا يمكن أن تنطبق على المنتجات التي تشترونها عبر قنوات البيع. يرجى الاتصال بمركز العلاقات مع العملاء للحصول على المزيد من التفاصيل.

(و)     عمليات الاستبدال

يجوز لكم إرجاع منتج اشتريتموه عبر قنوات البيع لاستبداله بمنتج آخر شريطة أن يمتثل المنتج المرتجع لشروط البيع هذه، ولا سيما البندين (أ) حق الإلغاء و(ب) عملية الإرجاع الواردين أعلاه. 

في أي حال، سيُلغى بيع المنتج المرتجع ويجب تقديم طلبية جديدة للمنتج المطلوب.

في حال إرجاع منتج إلى مركز التوزيع التابع لمتجر بانيراي الإلكتروني بغية استبداله بمنتج أرخص ثمنًا، يحق فقط لمشتري المنتج المرتجع استرداد فرق السعر.

إذا أُرجع منتج بغية استبداله في متجر من متاجر بانيراي المشاركة (يرجى الاتصال بمركز العلاقات مع العملاء لمعرفة متاجر بانيراي المشاركة) بمنتج أرخص ثمنًا، لا يحق للشخص الذي يرجع المنتج الحصول على رصيد فرق السعر. لا يمكن أن تنطبق أرصدة الشراء من المتجر إلّا على المنتجات التي تشترونها في متجر من متاجر تجزئة بانيراي المشاركة ولا يمكن أن تنطبق على المنتجات التي تشترونها عبر قنوات البيع. يرجى الاتصال بمركز العلاقات مع العملاء للحصول على المزيد من التفاصيل.

إذا تم إرجاع منتج لاستبداله بمنتج أغلى ثمنًا، فسيتعين عليكم دفع فرق السعر. 

ضمان المصنّع وحقوق المستهلك القانونية

نتعهّد بأن كل منتجاتنا تستوفي معايير الجودة الصارمة التي نأخذ بها وبأنها قد اجتازت جميع ضوابط الرقابة، الفنية والجمالية على حد سواء.

يشمل ضمان بانيراي الساري المنتجات المختارة. إذا أردتم إصلاح منتج مشمول بضمان بانيراي الساري، فيرجى الرجوع إلى ضمان بانيراي الساري والاتصال بمركز العلاقات مع العملاء للحصول على المزيد من المعلومات.

يجوز لكم، بصفتكم مستهلكين، ممارسة حقوق قانونية بمقتضى القانون الساري الذي يخضع له بيع السلع الاستهلاكية. ولا تؤثر شروط البيع هذه ولا ضمان بانيراي الساري في هذه الحقوق القانونية.

خدمات مجانية

يمكن الاستفادة من الخدمات المجانية التالية المتاحة عبر قنوات البيع:

(أ)  تغليف الهدايا

ستُشحن كل الطلبيات في صندوق هدايا بانيراي مغلفة بغلاف بانيراي مميّز بالإضافة إلى حقيبة تسوّق بانيراي (عند الاقتضاء).

لا يمكن إلغاء منتجات بانيراي التي تكتسي طابعًا شخصيًا ولا يمكن إرجاعها لبانيراي بغية استبدالها أو استرداد قيمتها.

(ب)  استبدال/ ضبط الحزام

يأتي حزام ساعة بانيراي بمقاس موحّد. يمكن أن يكون مقاس الحزام أصغر أو أكبر حسب بعض المنتجات. يرجى تحديد طلباتكم، إن وُجدت، على المنصات أو عبر الاتصال بمركز العلاقات مع العملاء. ضبط أحزمة ساعات بانيراي متاح أيضًا لبعض أطرزة الساعات. إذا طلبتم ضبط سوار الساعة، تُرجع إليكم الحلقات المنزوعة في الطرد المرسل إليكم.

(ج)  رسالة الهدية

يمكنكم أن تضفوا طابعًا شخصيًا على طلبيتكم بإضافة رسالة شخصية تطبعها بانيراي على بطاقة هدية تُضاف إلى شحنة طلبيتكم. تحتفظ بانيراي بالحق في رفض أي رسائل بطاقات الهدايا التي تراها مسيئة أو لا يليق إرسالها على ورق رسائل يحمل شعار بانيراي.

عمليات الإصلاح

إذا كان لديكم أيّ طلب إصلاح مرتبط بمنتج طلبتم شراءه عبر قنوات البيع، فيرجى الاطلاع على قسم الأسئلة الشائعة أو الاتصال بمركز العلاقات مع العملاء التابع لنا.

وصف المنتج

نسعى جاهدين إلى ضمان دقة وتمام المعلومات، بما فيها مواصفات المنتج، التي ترد على منصاتنا أو كتالوجاتنا أو التي يقدمها مركز العلاقات مع العملاء. لكننا لا نقدّم أيّ ضمان صريح أو ضمني بشأن دقة هذه المعلومات وموثوقيتها وكمالها. لا سيما كل المواصفات والمعلومات المتعلقة بالوزن والمواد الثمينة وعدد الأحجار والأوزان التي ترد لأغراض إيضاحية فقط والتي قد تختلف قليلًا. 

حدود المسؤولية

نرفض ونستثني كل الأحكام والشروط والضمانات الأخرى المرتبطة بالمنتجات وقنوات البيع إلى أقصى مدى يسمح به القانون الساري، سواء أنصّ عليها القانون أو غيره من الأحكام صراحةً أو ضمنًا أو نشأت عما سبق من أعراف تعامل أو استخدام أو ممارسة تجارية.

لا يوجد في شروط البيع هذه ما يحدّ من مسؤوليتنا أو يستبعدها لفائدة أيّة مسؤولية لا يمكن حدّها أو استبعادها بمقتضى القانون. رهنًا بالجملة السابقة، فإن مسؤوليتنا الإجمالية إزاءكم بموجب شروط البيع هذه فيما يتعلق بأيّ طلب لا تتجاوز بأيّة حال من الأحوال نسبة مئة بالمئة (100%) من سعر المنتج أو المنتجات الوارد في طلبيتكم، سواء بموجب العقد أو الضرر (ولا سيما التقصير) أو غيرهما، حتى إن أحطنا علمًا باحتمال حدوث مثل هذه الأضرار.

يرجى الانتباه إلى أنه في بعض الولايات القضائي، لا تنص قوانين حماية المستهلك على استثناء الضمانات أو المسؤوليات أو تحديد نطاقها، وبالتالي قد لا تنطبق بعض الاستثناءات أو القيود الواردة أعلاه.

أحكام عامة

إذا اعتُبر بند ما من بنود شروط البيع هذه أو جزء منه غير قانوني أو باطل أو لاغٍ، فسيُستبعد هذا البند أو جزء منه من شروط البيع هذه، ولن تتأثر شرعية البنود الأخرى المدرجة في شروط البيع هذه ولا صلاحيتها ولا سريان مفعولها، ما لم يقتض القانون المعمول به خلاف ذلك.

تشكّل شروط البيع هذه (والشروط المُدرَجَة عن طريق الإحالة المرجعية) الاتفاق الكامل المبرم بينكم وبيننا فيما يتعلق بطلب شراء المنتجات أو الاستفادة من الخدمات وتستبدل وتلغي كل الاتفاقات السابقة أو مشاريع الاتفاق أو الترتيبات أو الالتزامات أو أيّة عقود إضافية مبرمة بين الطرفين، سواء أكانت شفهية أم خطية فيما يتعلّق بهذا الموضوع.

لا نتحمل مسؤولية أيّ تقصير أو تأخير في تنفيذ التزاماتنا والوفاء بها بموجب شروط البيع هذه إذا عُزيَ ذلك لأيّ سبب خارج عن إرادتنا.

لن يُفسَّر تنازلنا عن تقصير ما في أيّ بند من بنود شروط البيع هذه بأنه تنازل عن أيّ تقصير لاحق.

هذا العقد مبرم بيننا وبينكم. لا يحق لأي شخص آخر فرض أيّ شرط من شروطه. لكن إذا اشتريتم منتجًا لإهدائه، فسيستفيد مستلم هديتكم من ضمان بانيراي الساري.

القانون المعمول به والولاية القضائية

تخضع شروط البيع هذه لقوانين البلد الذي يقع به مقر هيئة البيع المعنية وتُفسَّر وفقًا لها دون الرجوع إلى الأحكام المتصلة بالنزاعات القانونية ("القوانين المنطبقة"). يُحال أيّ نزاع أو خلاف أو دعوى ناجمة عن شروط البيع أو مرتبطة بها، بما في ذلك شرعية شروط البيع أو بطلانها أو انتهاكها أو إلغاؤها، إلى القضاء أو التحكيم طبقًا لشروط البيع. إذا اختلفت القوانين السارية عن قوانين حماية المستهلك الإلزامية السارية في بلدكم، فسنوفّر لكم حماية مماثلة.

يجوز لكم اتخاذ إجراءات قضائية ضدنا أمام محاكم البلد الذي يقع فيه مقر هيئة البيع أو في البلد الذي تقيمون به. يجوز لنا أيضًا اتخاذ إجراءات قضائية ضدكم في محاكم البلد الذي تقيمون به.

يجوز اتخاذ الإجراءات القضائية أمام المحاكم دون أيّ قيد أو شرط، ولكن تحاولون وبانيراي أولًا بذل جهود معقولة خلال مدة ثلاثين (30) يومًا لتسوية أيّ نزاع أو عدم اتفاق قد ينجم عن المنتج أو شروط البيع أو أيّ انتهاك لها بالتي هي أحسن.

إذا كنتم مستهلكين مقيمين في الاتحاد الأوروبي، فيحق لكم أن تقدّموا شكواكم إلى هيئة بديلة لتسوية النزاعات. لإيجاد قائمة الهيئات البديلة لتسوية النزاعات في بلدكم، يجوز لكم الرجوع إلى منصة اللجنة الأوروبية لفض النزاعات الإلكترونية على العنوان التالي: http://ec.europa.eu/consumers/odr/Entire Agreement.

About Panerai and these Conditions of Sale

These Conditions of Sale apply to any sales of Panerai products or services that you may order from our Selling Entity (as defined below):

(a)        the website and any associated mobile or digital applications that refer to these Conditions of Sale (the “Platforms”);

 

(b)        at a distance by either e-mail or phone from the relevant retail boutique of Panerai or our client relations center using Pay-by-Link or other digital in-store applications (the “Client Relations Center”), or

 

(c)        at the relevant retail boutique of Panerai or at an event outside of the relevant Panerai boutique using Pay-by-Link or other digital in-store applications (“Remote Boutique”);

(together the “Sales Channels”).

The selling entity that will sell the products to you is Richemont Asia Pacific Limited with its registered address at 6/F, Jardine House, One Connaught Place, Central, Hong Kong SAR (the “Selling Entity”, Panerai”, "we", "us" and "our"):

 Panerai, a division of Richemont Asia Pacific Limited, is an affiliate of Officine Panerai, Branch of Richemont International SA, which owns and edits the Platforms pursuant to the Terms of Use.  If placing an order by the Platforms, you agree to be bound by the Terms of Use , which are incorporated into these Conditions of Sale. In addition, our information collection practices and the ways in which we may use and protect that information, are further set out in our Privacy Policy . By using the Sales Channels and placing orders with Panerai, you agree to be bound by our Privacy Policy , which is incorporated into these Conditions of Sale by reference.

Please read these Conditions of Sale carefully. These Conditions of Sale are applicable to any order placed through the Sales Channels and include an agreement to arbitrate any disputes on an individual basis. Please note that before placing an order for products or services, you will be asked to agree to these Conditions of Sale. If you do not agree to these Conditions of Sale, then you will not be able to order any products or services through the Sales Channels.

All other sales concluded in person through usual physical points of sale (such as our retail boutiques) or third parties (such as authorized retailers) are not subject to these Conditions of Sale.

Updates to These Conditions of Sale

We may make changes from time to time to these Conditions of Sale so please check back regularly to keep informed of updates. The latest version of these Conditions of Sale will always be available on the Platforms. Any new version of these Conditions of Sale shall take effect immediately upon the date of posting and will govern any orders of products or services made as from that date. Any changes to the Conditions of Sale made after you have placed an order will not affect that order and your relationship with us, except as may be required by applicable law.

Purchasing Eligibility

Only individuals (and not legal entities) who (a) have reached the age of legal majority required to enter into contracts (eighteen); (b) have legal capacity to enter into contracts; and (c) have a shipping address in Hong Kong SAR may order products through the Sales Channels. If you are under the age of legal majority or otherwise cannot lawfully enter into a contract, you must have your parent or guardian place an order on your behalf and they will be asked to agree to these Conditions of Sale.

By placing an order through the Sales Channels, you represent and warrant that you are a bona fide end-user customer purchasing for your own or another’s personal use and will not deliver, sell or otherwise distribute our products or purchase our products or services for commercial purposes.

Product Availability & Quantity

All orders placed through the Sales Channels are subject to availability and acceptance of such orders by us. Products shown on the Platforms that cannot be added to the shopping bag are not available for sale via the Platforms. The Client Relations Center or Remote Boutique (as applicable) can provide more information as regards to these products. For information about the order process, please refer to our Order Process section below.

Quantity limits may apply in relation to orders for certain products. We reserve the right to refuse at any moment in time, without prior notice, orders exceeding a certain number of authorized products.

Account Registration & Guest Checkout

To place an order through the Platforms, you may either register and create an online account, or place an order as a guest without creating an online account by selecting the "Guest Checkout" option. Where you place an order as a guest, we may still create an account on our internal systems to record your purchase(s).

Personalized Services

Personalization services (for example engraving or embossing) or other services may be available on a selection of products. If you wish to have your product personalized, please provide the details in the Sales Channels as requested.

We reserve the right to withhold or refuse acceptance of any order for personalized products, or with a message card, that contains language that is objectionable, unlawful or contrary to our policies. You are responsible for ensuring that any wording you provide for personalizing products is correct.

In addition, orders for personalized products cannot be cancelled and such products that have been personalized in any way or otherwise made to your bespoke specifications cannot be returned to us for exchange or refund (except where defective), and are considered final upon receipt of a written Acknowledgement of Order and can therefore not be cancelled, as described in these Conditions of Sale. This does not affect your consumer rights under the law.

Order Process

The order process of the Platforms will include the following:

·            Add to Shopping Bag: Once you have chosen a product, you may place this product in your shopping bag. You may then decide to continue shopping for other products and add them to your shopping bag (subject to availability and quantity limits). Placing an item in your shopping bag does not guarantee availability for purchase, which is not confirmed until you receive a written Confirmation of Order & Shipment (not the Acknowledgement of Order), except for personalized products, where our Acknowledgement of Order constitutes our acceptance of your order and indicates the existence of a binding sales contract.

·            Guest/My Account Checkout: When you are ready, you then proceed to “Checkout”, either as a guest or through your registered account. You may also remove one or several products you have selected from the shopping bag as part of the checkout process. 

·            Delivery, Review and Payment: As part of the checkout process, you add and review your order details and personal information (including e-mail, shipping address, billing address and payment information). You should carefully check and confirm all details on the order summary page before placing your order. 

·            Placing of Order: You then check the relevant box and place your order.

In the case of an order being placed through the Client Relations Center or Remote Boutique, the Panerai ambassador will walk you through the steps above and verbally ask you to confirm the details of your order.

We reserve the right, in our sole discretion, to refuse, cancel and terminate orders at any time on reasonable grounds. For example, we may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order or if we suspect, in our sole discretion, that you have engaged in (i) fraudulent activities; (ii) the import of product activities which we have not intended; or (iii) have otherwise violated these Conditions of Sale, including for example any engraving that contains language that is objectionable, unlawful or contrary to our policies.

Prices, Taxes and Shipping Costs

All prices shown or quoted by the applicable Sales Channels are in Hong Kong Dollars unless otherwise stated and include sales taxes (if any) but exclude shipping costs and other taxes unless otherwise stated. Sales, use or other taxes will vary based on the location to which products are being shipped.  You should check updated prices and currency carefully.

Shipping costs, if any, are described in the Shipping Policy below or on the Sales Channels. Shipping costs are not stated on the product pages but will be added to the product price after you have chosen your delivery options. These costs will be summarised before you are asked to confirm and place your order and will also be reflected in our email correspondence with you once you have chosen your delivery options.

Please note that sales taxes associated with your purchase will vary based on the location to which products are being shipped and will be presented before you place your order.

We reserve the right to modify prices and delivery costs at any time without prior notice. We take reasonable care that the prices of products and delivery costs are correct at the time when the relevant information was entered into the system or communicated to you via the Sales Channels. However, it is always possible that, despite our reasonable efforts, some of the products offered through our Sales Channels or delivery costs may be incorrectly priced. If any of the products you place an order for or any delivery costs are incorrectly priced, we will contact you as soon as possible to inform you of this error. If we are unable to contact you using the contact details you have provided during the order process, we will cancel the order and notify you in writing. If we mistakenly accept and process your order where a pricing or delivery cost error occurs, we may cancel supply of the product and refund you any sums you have paid.

Please note that changes to applicable law between the date your order is placed and the date you are sent a written Confirmation of Order & Shipment may result in changes to the taxes associated with your order. Payment

We accept the methods of payment identified as part of the order process via the Sales Channels. Depending upon the means of payment, we may require additional information, including specific forms of identification.

When ordering on the Platforms using our Pay-by-Link process, you will need to enter your payment details on the appropriate form.  In the case of an order placed by telephone, you will need to communicate to the Client Relations Center or Remote Boutique your complete payment details. All payment card holders are subject to validation check and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, you will need to contact your card issuer directly to solve this problem.

Other payment methods may also be subject to validation checks and authorization by the payment system providers as well. You expressly authorize us to perform security checks, where we deem necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time, including but not limited to your payment card details, to authenticate your identity, to validate your payment card, to obtain an initial payment card authorization and to authorize individual purchase transactions.

We accept bank wire transfer for orders placed through the Client Relations Center. We do not charge a fee for bank wire transfers for orders made through the Client Relations Center, however, some financial institutions may charge a fee for using a bank wire transfer. We require that all bank wire transfer orders placed by telephone be confirmed through an order approval process. We may acknowledge a bank wire transfer order, but the order will not be processed until the payment has been received and confirmed by us by e-mail. Please be advised that payments by wire transfer require additional processing through our ambassador and that there might be an additional waiting period before product can be released depending on the value of the product ordered. If your wire transfer payment is not credited into our bank account within seven (7) days after you have placed your order, your order will be cancelled.

Where we offer Credit Card, PayPal/PayPal Express/Alipay/WeChat Pay/Apple Pay or any other similar payment service as specified on the Sales Channels as a payment method, the full amount of your purchase may be debited on your payment card immediately following the placement of your order or when payment is approved by the payment provider. Pre-payment shall not impact any of your legal rights under these Conditions of Sale (including for example any right of refund). If we cannot meet our shipping and/or delivery obligations set out below, we will notify you via e-mail and we will refund the pre-payment without undue delay.

Credit card companies may allow you to pay for your products in instalments. This payment method will be subject to the terms and conditions of your credit card company.

Acknowledgement of Order

Once you have made your choice and your order has been placed through the Sales Channels, you will receive a written Acknowledgement of Order (by e-mail or otherwise confirming the details of your order together with an order reference number). Please make sure that you save this order reference number for any future enquiries regarding your order. This Acknowledgement of Order is not an acceptance of your order. To confirm the order, we will conduct its usual credit, anti-fraud, security and related legal checks and, if acceptable, will then process your order. Upon receipt of the Acknowledgement of Order, it is your responsibility to review it and confirm that it accurately reflects your intended order.  If you have any questions or concerns or if the Acknowledgement of Order does not reflect your intentions, you should contact the Client Relations Center or Remote Boutique (as applicable) promptly. 

These Conditions of Sale will be provided to you when we acknowledge your order.

Shipping Policy

We only accept orders for delivery to the address in Hong Kong SAR. Please note that we do not ship to certain addresses, such as military, certain restricted areas (such as hotels), pick-up points, or PO boxes. For further information, please refer to our FAQs section or contact the Client Relations Center or Remote Boutique.

Boutique pick-up may be offered, free of charge, to certain locations. Please refer to the FAQs section  or call the Client Relations Center or Remote Boutique for more information. We will inform you by e-mail or by telephone when the product is ready for pick-up at the boutique.

Please note that not all pick-up locations are able to accommodate pick up of the product within the same time frame and that certain product is not available at all pickup locations at all times.

If you order several products, we will ship the order only once all products are available (there will be no partial shipments, unless otherwise communicated to you.

Confirmation of Order & Shipment

Upon shipment of your order, we will send you a Confirmation of Order & Shipment in writing (by e-mail or otherwise). This Confirmation of Order & Shipment constitutes our acceptance of your order and indicates the existence of a binding sales contract, except for personalized products (if available) where our Acknowledgement of Order constitutes our acceptance of your order and indicates the existence of a binding sales contract.

We reserve the right not to accept your order for any reason in our discretion. Such non-acceptance may result, for example, from the fact that the product ordered is out of stock or that we are unable to obtain authorisation for your payment or that you do not meet the terms of eligibility above.

Delivery

We will use reasonable efforts to ensure delivery by the carrier within the estimated delivery lead time from the date of our written Confirmation of Order & Shipment and in any event within thirty (30) days after that date, except if your purchase relates to a product or service that we have explained to you will take additional time to deliver, for example in the case of products or services that we personalize or produce to your specifications.

When ordering through the Sales Channels, you may be able to choose a specific delivery date as available on the Sales Channels. Any such specific delivery date remains subject to our confirmation.

If delivery of products is delayed by an event outside our control, we will inform you as soon as possible and will use reasonable efforts to minimise the effect of the delay. If we do not deliver within thirty (30) days from the date of the written Confirmation of Order & Shipment or any other time limit as indicated by us, you may contact the Client Relations Center or Remote Boutique (as applicable) to cancel the relevant order and get a refund of any sums you pre-paid us for any products which you have not received. 

In any event, your sole remedy for any failure by us to deliver the order to you shall be your right to cancel the relevant order and receive a refund of sums you pre-paid us for any products which you have not received.

When estimating your delivery time, please allow time for credit approval, address verification, security checks and order processing. Please note that delivery is always subject to receiving your full payment.

We will require a handwritten or electronic signature by you, or a person at the nominated delivery address (unless arranged by you otherwise), to confirm the delivery of each product, at which point risk and responsibility for your purchased goods passes to you.  If you have specified a recipient who is not you for delivery purposes (for example, as a gift), then you understand and accept that evidence of a signature by such recipient (or a person at the delivery address) is evidence of delivery and fulfilment of the sales contract by Panerai and transfer of responsibility to the recipient in the same way as if the product had been delivered to you. We reserve the right to deliver products only to the person who is the intended recipient of the order as stated on the label of the parcel and to request ID check for verification purposes at the time of delivery for certain categories of products. Invoices

When ordering products via the Sales Channels, you will receive an invoice that will be sent to you in writing (to your e-mail address as a PDF attachment or otherwise).

Returns and Exchanges

Panerai allows you or the Gift Recipient (as defined below) to return Panerai products purchased through the Platforms or Client Relations Center within 14 days following delivery, but subject to the further terms and conditions set forth below.[Legal1] 

(a)   Return Process

Products that have been purchased through the Platforms or Client Relations Center may only be returned to our Panerai e-boutique distribution center at the address of our Returns Department, as provided in our FAQs section through our Client Relations Center, or if available to selected Panerai retail boutiques, in accordance with these Conditions of Sale. For a list of available boutiques return locations please contact the Panerai Client Relations Center.

To return a product purchased from a Remote Boutique, please call the Panerai Boutique for details of their returns process.

Products that have not been purchased through the Sales Channels may NOT be returned to our e-boutique distribution center. For example, if you purchase a product at a retail boutique not using Pay-by-Link, you should return it at that boutique.  

To return a product to our e-boutique distribution center, you must follow the steps mentioned below: 

(i)              Call the Client Relations Center; to agree on a pick-up date by our logistics partner. You may be asked at this stage to provide photos of the product for us to make a first assessment of the condition of this product,

(ii)            The Client Relations Center will send you a Return Form by email, after an initial assessment based on the photos of the product,

(iii)           Please fill out the required information on the return form enclosed with your order and sign it;

(iv)           You must include in the delivery package, the completed return form along with the product, with the return authorization number, all its accessories, any free items you received as part of your order, the Service Guide, the warranty card and all other documents, in their original box;

(v)            Please seal the delivery package

(vi)           On the agreed date, our logistics partner will bring you a pre-paid airway bill and pick-up the sealed delivery package.

 

 

You must keep a proof of return shipment, and we accept no liability in the event that such proof cannot be produced. Only merchandise received by our Panerai e-boutique distribution center will be eligible for a refund or exchange.

You may be able to return the product to a Panerai retail boutique. Please refer provided to our FAQs section  or call the Client Relations Center for further details. You may be asked to provide information about the products for us to make a first assessment of the condition of these products.

(b)   Condition of Returned Products

We will verify that the returned product satisfies the conditions of the Returns and Exchanges Policy and, if so, then proceed with the applicable refund or exchange.

Our products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original Panerai box and delivery package, including all accessories and documents. For example, timepiece bracelets that have been adjusted at your request must be returned with the exact same number of links as in the original delivery package. We reserve our right not to accept any return if the product shows signs of wear or has been used or altered from its original condition in any way or, as an alternative, may reduce the amount of any applicable refund or exchange accordingly.

If you have received free items as part of your order, they must be returned with the products.

All returns will be subject to strict Quality Control (“QC”) by us to ensure that the returned products satisfy these requirements. If the products do not meet QC standards, we will refuse the return, and the products will be returned to you. If the returned product satisfies QC, we will proceed with the applicable refund or exchange.

Failure to comply with these Conditions of Sale will entitle us to refuse the returned product and send it back to you, at your own cost.

(c)   Products You Cannot Return or Exchange

To the extent permitted by law, orders for products that have been personalized in any way or otherwise made for you with bespoke specifications cannot be cancelled and such products cannot be returned to us for exchange or refund. This includes, without limitation, products that have been engraved or embossed.

(d)   Refunds

You may return a product purchased through the Sales Channels for refund, provided that the return complies with these Conditions of Sale. Personalized products are strictly non-refundable.

Only the buyer will be entitled to receive a refund of the purchase price. In no event will a person who has received the product as a gift (i.e. a “Gift Recipient”) be entitled to receive a refund. If you are a Gift Recipient and wish to return a product, please contact the Client Relations Center or Remote Boutique to discuss your options.

If the return complies with these Conditions of Sale, we will use commercially reasonable endeavours to refund the purchase price to the buyer using the same means of payment as used by the buyer for the initial transaction within fourteen (14) days after receipt of the returned item by the Panerai e-boutique distribution center.

(e)   Exchanges

You may return a product purchased through the Sales Channels for exchange with another Panerai product, provided that the return complies with these Conditions of Sale and provided the product desired for exchange is available.

In any event, the sale of the returned product will be cancelled and a new order for the product ordered must be placed.

Should a product be returned to the Panerai e-boutique distribution center for exchange with a less expensive product, only the buyer of the returned product will be entitled to receive a refund of the price difference.

If a product is returned for exchange with a more expensive product, you will have to pay the price difference.

Should a product be returned for exchange to a participating Panerai retail boutique for exchange (please refer to our FAQs section or contact the Client Relations Center to find out about our participating Panerai retail boutiques) with a less expensive product, the individual making the return will only be entitled to receive a merchandise credit of the price difference. Boutique merchandise credits can only be applied to products purchased in a participating Panerai retail boutique and cannot be applied to products purchased through the Sales Channels. Please refer to our FAQs section or contact the Client Relations Center for further details.

 [Legal1]In HK, so far it is not mandatory to offer the right to cancel to customers for e-commerce transactions.  Maison to consider whether to give such flexibility and to confirm this entire Returns and Exchanges section (a) to (e).

Complimentary Services

The following complimentary services will be proposed, free of charge, by the Sales Channels:

(a)  Gift Wrap and Packaging

All orders will be shipped with the Panerai box gift wrapped in Panerai special packaging, together with a Panerai shopping bag (where applicable).

Orders for personalized Panerai products cannot be cancelled and personalized Panerai products cannot be returned to Panerai for exchange or refund.

(c)  Strap Exchange / Adjustment

A Panerai watch strap is delivered in a standard size. The strap size can be delivered smaller or larger, upon request, by calling the Client Relations Center or Remote Boutique. Panerai watch strap adjustment is also available on certain watch models. If you request a watch bracelet adjustment, the removed links will be returned to you and included in the delivery package.

(d)  Gift Note

You may personalize your order by adding a personalized note that will be printed by Panerai on a gift card to be included in your order package. Panerai reserves the right to reject gift card notes it deems offensive or inappropriate to be sent on Panerai-logo stationery.

Product Descriptions

We try to ensure that the information, including product descriptions, dimensions, and colours, provided on the Platforms, in advertisements or catalogues or as provided by the Client Relations Center or Remote Boutique is accurate and complete. However, to the extent permitted by law, we make no guarantees, whether express or implied, in relation to the accuracy, reliability and completeness of such information. In particular, any description and information concerning the weight of precious materials and the number of stones and carats are provided as an indication only and may vary slightly.

Limitation of Liability

To the fullest extent permitted by applicable law, we disclaim and exclude all other terms, conditions and warranties in relation to the products and Sales Channels whether express or implied by statute or otherwise or arising from any previous course of dealing or usage or trade practice.

Nothing in these Conditions of Sale limits or excludes our liability for any liability which cannot be limited or excluded by applicable law of Hong Kong SAR. Subject to the preceding sentence,  our aggregate liability to you under these Conditions of Sale for any order whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages shall in no event exceed the one hundred percent (100%) of the price of the product(s) in your order.

General Provisions

If any provision, or part of a provision, of these Conditions of Sale is deemed to be illegal, invalid or unenforceable, the remainder of the provisions of these Conditions of Sale shall be unaffected and shall continue to be fully valid, binding and enforceable.

These Conditions of Sale (and associated terms incorporated by reference) constitute the entire agreement between you and us in relation to the order of products or services, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature made by the parties, whether oral or written, in relation to such subject matter.

We are not responsible for any failure or delay in performing or complying with our obligations under these Conditions of Sale which arises from any cause beyond our reasonable control.

The waiver by us of a breach of any provision of these Conditions of Sale will not operate to be interpreted as a waiver of any other or subsequent breach.

This contract is between us and you. No other person shall have any rights to enforce any of its terms. However, if you purchase a product as a gift, the recipient of your gift will have the benefit of the product.

Applicable law and jurisdiction

These Conditions of Sale shall be governed by and construed in accordance with the laws Hong Kong SAR.

Without any restriction to bring proceedings before a court, you and Panerai will first make reasonable efforts for a period of thirty (30) days to resolve amicably any dispute or failure to agree that may arise out of or relate to the product, the Conditions of Sale or any breach thereof.

The following terms and conditions and any other related rules that are adopted by Panerai and made available as provided herein (collectively, the “Conditions of Sale”) shall apply to all sales of products that you (the “Customer” or “you”) may order from Richemont Australia Pty. Limited, Level 8, 74 Castlereagh Street, Sydney NSW 2000, Australia (“Panerai, or referred to herein as us, ourorwe”) on the Internet via the Panerai Website, identified by (if applicable) the domain name www.panerai.com (the“Website”) or by phone (1800 271 037) via the customer contact center of Panerai (the “Client Relations Center”). For the avoidance of doubt, the E-boutique Website will be available at a later stage.

 

These Conditions of Sale are applicable to any order placed through the Client Relations Center or the Website. If you refuse to accept these Conditions of Sale, you will not be able to order any Panerai products from the Website or the Client Relations Center. Sales concluded through Panerai authorized retailers or physical points of sale are not subject to these Conditions of Sale.

 

Your use of the Website is governed by our Terms of Use. In addition, our information collection practices, such as the types of information we collect regarding visitors to the Website, or callers to the Client Relations Center, and the ways in which we may use and protect that information, are further set out in our Privacy Policy. By using the Client Relations Center or the Website you are deemed, by virtue of such use, to have agreed to be bound by the Terms of Use and Privacy Policy, which are incorporated into these Conditions of Sale by reference (and are available here Terms of Use, Privacy Policy ). The Conditions of Sale, Terms of Use and Privacy Policy may be updated at any time by us without notice.

PURCHASING ELIGIBILITY

Only individuals (and not legal entities) who (a) have reached the age of eighteen (18), (b) have legal capacity to enter into contracts and (c) have a shipping address in the country or countries listed in Clause 14 may order products through the Client Relations Center or on the Website. If you are under the age of eighteen (18) or otherwise cannot lawfully enter into a contract, you must have your parent or guardian place an order on your behalf and thereby assent to these Conditions of Sale. By placing an order through the Client Relations Center or on the Website, you represent and warrant that you are a bona fide end-user customer and will not deliver, sell or otherwise distribute Panerai products or purchase Panerai products for commercial purposes or any other commercial benefit.

PRODUCT AVAILABILITY; QUANTITY

All orders placed through on the Website are subject to availability and acceptance by Panerai. Quantity limits may apply in relation to certain products. Panerai further reserves the right to refuse at any moment in time, without prior notice, orders exceeding a certain number of authorized products.

ACCOUNT REGISTRATION; GUEST CHECKOUT

In order to place an order, you or the Panerai Ambassador (on your behalf) may either register and create an online account, or place an order as a guest without creating an online account by selecting the "Guest Checkout" option.

ORDERS

If you are ordering on the Website, orders will be processed as follows: Once you have chosen a product, you may place this product in your shopping bag. You may then decide to continue shopping for other products and add them to your shopping bag (subject to availability and quantity limits) or proceed to “Checkout”. You may also remove one or several products you have selected from the Shopping Bag. Once on the payment page, review your order details and personal information (including email, shipping address, billing address and payment information), check the box next to “I have read and I accept the Conditions”. Then, place your order. Notwithstanding anything to the contrary provided for herein, Panerai reserves the right to refuse, cancel and terminate orders at any moment in time. For example, Panerai may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order or if Panerai suspects, in its sole discretion, that you have engaged in fraudulent or grey market activities or have otherwise violated these Conditions of Sale or the policies incorporated herein by reference.

PRICES, TAX AND SHIPPING COSTS

All prices shown on the product pages of the Website or quoted by the Client Relations Center are in Australian Dollars. Panerai reserves the right to modify prices and delivery costs at any time without prior notice. The price of and delivery costs displayed on the Website or quoted by the Client Relations Center, at the time Panerai provides you with a Confirmation of Order will be honored by Panerai. Actual shipping costs and applicable taxes will be reflected on your payment page before you are asked to confirm and place your order (in the case of a Website order) and will also be reflected in the Confirmation of Order. Delivery costs, if any, are described in the shipping policy set forth below and specified on the Website. Sales and use taxes will vary based on the location to which products are being shipped. Delivery costs and estimated sales and use taxes are not stated on the product pages but will be added to the product price, if applicable, after you have chosen your delivery location and options. PAYMENT

In order to process your order, we may perform security checks on your credit card. The full amount of your purchase will be blocked on your credit card until your order is shipped to the shipping address you have provided to Panerai, at which point in time you will be sent a Confirmation of Order and your credit card will be charged the applicable purchase price. Wire transfer payment is available through the Client Relations Center. All customers must provide proper form of identification when making a purchase by bank wire transfer. Panerai does not charge a fee for bank wire transfers; however, some financial institutions will charge a fee for using a bank wire transfer . REVIEW AND CONFIRMATION

ACKNOWLEDGEMENT OF ORDER

Once you have made your choice and your order has been placed on the Website, you will receive an Acknowledgment of Order in writing (by email or otherwise), acknowledging the details of your order. Please make sure that you save this Order Reference Number for any future enquiries regarding your order. This Acknowledgment of Order is not an acceptance of your order. Following the transmission of the Acknowledgment of Order, Cartier will conduct its usual credit, anti-fraud, security and related legal checks and, if acceptable, will then process your order.

These Conditions of Sale will be provided to you with the Acknowledgement of Order. Please carefully review these Conditions of Sale upon receipt.

CONFIRMATION OF ORDER

Upon shipment of your order, following completion by Panerai of its anti-fraud, security and related legal checks, Panerai will send you in writing (by email or otherwise) a written Confirmation of Order. The Written Confirmation of Order constitutes the acceptance of your order by Panerai and indicates the existence of a binding sales contract.

PROOF OF AGREEMENT

The Acknowledgement of Order and Confirmation of Order that are sent to you are deemed to be received when you are able to access them. The Acknowledgment of Order, Confirmation of Order and any automatic recording systems used by the Client Relations Center or the Website will be proof of a binding agreement between you and Panerai.

COMPLIMENTARY SERVICES

Bracelet adjustment can be available on the material metal and ceramic. If you wish to have your bracelet adjusted, please provide the details on the Website or to the Client Relations Center.

SHIPPING POLICY

We only accept orders for delivery to addresses in Australia. Please note that Panerai does not ship to military or certain restricted areas, PO boxes, or hotels. If you order several products, Panerai will ship the order only once all products are available (no partial shipments). We will use commercially reasonable efforts to deliver the products, or to ensure the delivery by our third party shipping provider, on the estimated delivery date mentioned in your order. DELIVERY

We will require a handwritten or electronic signature by you, or an adult acting on your behalf, to confirm the delivery of each Panerai product, at which point responsibility for your purchased goods passes to you.

INVOICES

When ordering products on the Website or Client Relations Center, you will receive, as the buyer, an invoice that will be sent to in writing (to your email address as a .pdf attachment or otherwise). You may also at anytime later request an invoice by calling the Client Relations Center. Panerai may request that you provide proper identification as a condition to comply with such request.

RETURN POLICY

In order to ensure your satisfaction, you may return Panerai products delivered in the country or countries listed in Clause 14, in accordance with the return and exchange policy set forth below. Returns of Panerai products that are not in compliance with the conditions and timeframes set forth below may be rejected by Panerai and will be sent back to you.

Panerai allows you to return in the country or countries listed in Clause 14, Panerai products purchased on the Website or though the Client Relations Center within fourteen (14) days from the day you received your product, subject to the further terms and conditions set forth below.


 

17.2. Return Process

Panerai Products that have not been purchased on the Website or through the Client Relations Center may NOT be returned to the Panerai e-boutique distribution center. To return a product to the Panerai e-boutique distribution center, you must follow the steps mentioned below:

 

       i. Please, call the Client Relations Center (telephone number indicated on the Website) to agree on a pick-up date by our logistics partner VISA. You may be asked at this stage to provide photos of the product for us to make a first assessment of the condition of this product,

     ii. The Client Relations Center will send you a Return Form and pre-paid airway bill by email, after an initial assessment based on the photos of the product,

    iii. Please, fill out the required information on the Return Form and sign it,

    iv. You must include in the delivery package, the completed Return Form along with the product, all its accessories, the Service Guide, the Warranty Card and all other documents, in their original box,

     v. Please, seal the delivery package and affix the pre-paid airway bill outside it,

    vi. On the agreed date, VISA will pick-up the sealed delivery package.

 

You must keep a proof of return shipment, and Panerai accepts no liability in the event that such proof cannot be produced. Only merchandise received by the Panerai e-boutique distribution center will be eligible for a refund or exchange.


 

17.3. Condition of Returned Products

Panerai will verify that the returned product satisfies the conditions of the return policy and, if so, then proceed with the applicable refund or exchange. Panerai products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original Panerai box and delivery package, including all accessories and documents. Panerai will not accept any return if the product shows signs of wear, or has been used or altered from its original condition in any way.

 

Personalized products cannot be returned to Panerai for refund or exchange. This includes, without limitation, straps that have been adjusted.

 

If you have received free items as part of your order, they must be returned with the products. Watch bracelets that have been adjusted at your request must be returned with the exact same number of links as in the original delivery package. All returns will be subject to strict Quality Control (QC) by Panerai to ensure that the returned products satisfy these requirements. If the products do not meet QC standards, Panerai will refuse the return, and the products will be sent back to you. If the returned product satisfies Quality Control (QC), Panerai will proceed with the applicable refund or exchange. Failure to comply with the return process above or the return conditions will entitle Panerai to refuse the returned product and send it back to you, at your own cost.


 

17.4. Refunds

You may return a product purchased on the Website or through the Client Relations Center for refund, provided that the return complies with these Conditions of Sale. Should a product be returned to the Panerai e-boutique distribution center, only the buyer will be entitled to receive a refund of the purchase price. In no event will a person who has received the Panerai Product as a gift (i.e. a “the Gift Recipient”) be entitled to receive a refund. If the return complies with these Conditions of Sale, Panerai will use commercially reasonable efforts to refund the purchase price to the buyer using the same means of payment as used by the buyer for the initial transaction, within fourteen (14) days after receipt of the returned item by the Panerai e-boutique distribution center. Except for delivery of an originally defective product (as defined below), initial shipping charges will not be refunded.


 

17.5. Exchanges

You may return a product purchased on the Website or through the Client Relations Center for exchange with another Panerai product, provided that the return complies with these Conditions of Sale. In any event, the sale of the returned product will be cancelled and a new order for the product ordered must be placed. Should a product be returned to the Panerai e-boutique distribution center for exchange with a less expensive product, only the original buyer of the returned product will be entitled to receive a refund of the price difference. If a product is returned for exchange with a more expensive product, you will have to pay the price difference.

ORDERS

If you are ordering on the Website, orders will be processed as follows: Once you have chosen a product, you may place this product in your shopping bag. You may then decide to continue shopping for other products and add them to your shopping bag (subject to availability and quantity limits) or proceed to “Checkout”. You may also remove one or several products you have selected from the Shopping Bag. Once on the payment page, review your order details and personal information (including email, shipping address, billing address and payment information), check the box next to “I have read and I accept the Conditions”. PAYMENT BY BANK WIRE TRANSFER

Wire transfer payment is available through the Client Relations Center. All customers must provide proper form of identification when making a purchase by bank wire transfer. Panerai does not charge a fee for bank wire transfers; however, some financial institutions will charge a fee for using a bank wire transfer . Panerai requires that all bank wire transfer orders by phone be confirmed through an order approval process. Panerai may acknowledge a bank wire transfer order, but the order will not be processed until the payment has been received and confirmed by Panerai by email. If your wire transfer payment is not credited into our bank account within seven (7) days after you have placed your order, your order will be cancelled.

REVIEW AND CONFIRMATION

You should carefully check and confirm all details on the payment page before placing your order. In the case of an order being placed through the Client Relations Center, the Panerai Ambassador will verbally ask you to confirm the details of your order.

ACKNOWLEDGEMENT OF ORDER

Once you have made your choice and your order has been placed on the Website, you will receive an Acknowledgment of Order in writing (by email or otherwise), acknowledging the details of your order. Please make sure that you save this Order Reference Number for any future enquiries regarding your order. This Acknowledgment of Order is not an acceptance of your order. Following the transmission of the Acknowledgment of Order, Cartier will conduct its usual credit, anti-fraud, security and related legal checks and, if acceptable, will then process your order.

CONFIRMATION OF ORDER

Upon shipment of your order, following completion by Panerai of its anti-fraud, security and related legal checks, Panerai will send you in writing (by email or otherwise) a written Confirmation of Order. The Written Confirmation of Order constitutes the acceptance of your order by Panerai and indicates the existence of a binding sales contract.

PROOF OF AGREEMENT

The Acknowledgement of Order and Confirmation of Order that are sent to you are deemed to be received when you are able to access them. The Acknowledgment of Order, Confirmation of Order and any automatic recording systems used by the Client Relations Center or the Website will be proof of a binding agreement between you and Panerai.

COMPLIMENTARY SERVICES

Bracelet adjustment can be available on the material metal and ceramic. If you wish to have your bracelet adjusted, please provide the details on the Website or to the Client Relations Center.

SHIPPING POLICY

We only accept orders for delivery to addresses in Australia. Please note that Panerai does not ship to military or certain restricted areas, PO boxes, or hotels. If you order several products, Panerai will ship the order only once all products are available (no partial shipments). We will use commercially reasonable efforts to deliver the products, or to ensure the delivery by our third party shipping provider, on the estimated delivery date mentioned in your order. When estimating package delivery time, please allow time for credit approval, address verification and order processing. Please note that it is always subject to receiving your full payment.

DELIVERY

We will require a handwritten or electronic signature by you, or an adult acting on your behalf, to confirm the delivery of each Panerai product, at which point responsibility for your purchased goods passes to you.

INVOICES

When ordering products on the Website or Client Relations Center, you will receive, as the buyer, an invoice that will be sent to in writing (to your email address as a .pdf attachment or otherwise). RETURN POLICY

In order to ensure your satisfaction, you may return Panerai products delivered in the country or countries listed in Clause 14, in accordance with the return and exchange policy set forth below. Returns of Panerai products that are not in compliance with the conditions and timeframes set forth below may be rejected by Panerai and will be sent back to you.

Panerai Products that have not been purchased on the Website or through the Client Relations Center may NOT be returned to the Panerai e-boutique distribution center. To return a product to the Panerai e-boutique distribution center, you must follow the steps mentioned below:

 

       i. Please, call the Client Relations Center (telephone number indicated on the Website) to agree on a pick-up date by our logistics partner VISA. You may be asked at this stage to provide photos of the product for us to make a first assessment of the condition of this product,

Where we offer PayPal/PayPal Express/Alipay/WePay as a payment method, the full amount of your purchase may be taken immediately following the placement of your order. PAYMENT BY BANK WIRE TRANSFER

Wire transfer payment is available through the Client Relations Center. All customers must provide proper form of identification when making a purchase by bank wire transfer. Panerai does not charge a fee for bank wire transfers; however, some financial institutions will charge a fee for using a bank wire transfer . Panerai requires that all bank wire transfer orders by phone be confirmed through an order approval process. Panerai may acknowledge a bank wire transfer order, but the order will not be processed until the payment has been received and confirmed by Panerai by email. If your wire transfer payment is not credited into our bank account within seven (7) days after you have placed your order, your order will be cancelled.

ACKNOWLEDGEMENT OF ORDER

CONFIRMATION OF ORDER

Upon shipment of your order, following completion by Panerai of its anti-fraud, security and related legal checks, Panerai will send you in writing (by email or otherwise) a written Confirmation of Order. The Written Confirmation of Order constitutes the acceptance of your order by Panerai and indicates the existence of a binding sales contract.

PROOF OF AGREEMENT

The Acknowledgement of Order and Confirmation of Order that are sent to you are deemed to be received when you are able to access them. The Acknowledgment of Order, Confirmation of Order and any automatic recording systems used by the Client Relations Center or the Website will be proof of a binding agreement between you and Panerai.

COMPLIMENTARY SERVICES

Bracelet adjustment can be available on the material metal and ceramic. If you wish to have your bracelet adjusted, please provide the details on the Website or to the Client Relations Center.

SHIPPING POLICY

We only accept orders for delivery to addresses in Australia. Please note that Panerai does not ship to military or certain restricted areas, PO boxes, or hotels. If you order several products, Panerai will ship the order only once all products are available (no partial shipments). We will use commercially reasonable efforts to deliver the products, or to ensure the delivery by our third party shipping provider, on the estimated delivery date mentioned in your order. When estimating package delivery time, please allow time for credit approval, address verification and order processing. Please note that it is always subject to receiving your full payment.

DELIVERY

We will require a handwritten or electronic signature by you, or an adult acting on your behalf, to confirm the delivery of each Panerai product, at which point responsibility for your purchased goods passes to you.

INVOICES

When ordering products on the Website or Client Relations Center, you will receive, as the buyer, an invoice that will be sent to in writing (to your email address as a .pdf attachment or otherwise). You may also at anytime later request an invoice by calling the Client Relations Center. Panerai may request that you provide proper identification as a condition to comply with such request.

RETURN POLICY

In order to ensure your satisfaction, you may return Panerai products delivered in the country or countries listed in Clause 14, in accordance with the return and exchange policy set forth below. Returns of Panerai products that are not in compliance with the conditions and timeframes set forth below may be rejected by Panerai and will be sent back to you.

 


17.1. Return Period

Panerai allows you to return in the country or countries listed in Clause 14, Panerai products purchased on the Website or though the Client Relations Center within fourteen (14) days from the day you received your product, subject to the further terms and conditions set forth below.


 

17.2. Return Process

Panerai Products that have not been purchased on the Website or through the Client Relations Center may NOT be returned to the Panerai e-boutique distribution center. To return a product to the Panerai e-boutique distribution center, you must follow the steps mentioned below:

 

       i. Please, call the Client Relations Center (telephone number indicated on the Website) to agree on a pick-up date by our logistics partner VISA. You may be asked at this stage to provide photos of the product for us to make a first assessment of the condition of this product,

     ii. The Client Relations Center will send you a Return Form and pre-paid airway bill by email, after an initial assessment based on the photos of the product,

    iii. Please, fill out the required information on the Return Form and sign it,

    iv. You must include in the delivery package, the completed Return Form along with the product, all its accessories, the Service Guide, the Warranty Card and all other documents, in their original box,

     v. Please, seal the delivery package and affix the pre-paid airway bill outside it,

    vi. On the agreed date, VISA will pick-up the sealed delivery package.

 

You must keep a proof of return shipment, and Panerai accepts no liability in the event that such proof cannot be produced. Only merchandise received by the Panerai e-boutique distribution center will be eligible for a refund or exchange.


 

17.3. Condition of Returned Products

Panerai will verify that the returned product satisfies the conditions of the return policy and, if so, then proceed with the applicable refund or exchange. Panerai products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original Panerai box and delivery package, including all accessories and documents. Panerai will not accept any return if the product shows signs of wear, or has been used or altered from its original condition in any way.

 

Personalized products cannot be returned to Panerai for refund or exchange. This includes, without limitation, straps that have been adjusted.

 

If you have received free items as part of your order, they must be returned with the products. Watch bracelets that have been adjusted at your request must be returned with the exact same number of links as in the original delivery package. All returns will be subject to strict Quality Control (QC) by Panerai to ensure that the returned products satisfy these requirements. If the products do not meet QC standards, Panerai will refuse the return, and the products will be sent back to you. If the returned product satisfies Quality Control (QC), Panerai will proceed with the applicable refund or exchange. Failure to comply with the return process above or the return conditions will entitle Panerai to refuse the returned product and send it back to you, at your own cost.


 

17.4. Refunds

You may return a product purchased on the Website or through the Client Relations Center for refund, provided that the return complies with these Conditions of Sale. Should a product be returned to the Panerai e-boutique distribution center, only the buyer will be entitled to receive a refund of the purchase price. In no event will a person who has received the Panerai Product as a gift (i.e. a “the Gift Recipient”) be entitled to receive a refund. If the return complies with these Conditions of Sale, Panerai will use commercially reasonable efforts to refund the purchase price to the buyer using the same means of payment as used by the buyer for the initial transaction, within fourteen (14) days after receipt of the returned item by the Panerai e-boutique distribution center. Except for delivery of an originally defective product (as defined below), initial shipping charges will not be refunded.


 

17.5. Exchanges

You may return a product purchased on the Website or through the Client Relations Center for exchange with another Panerai product, provided that the return complies with these Conditions of Sale. In any event, the sale of the returned product will be cancelled and a new order for the product ordered must be placed. Should a product be returned to the Panerai e-boutique distribution center for exchange with a less expensive product, only the original buyer of the returned product will be entitled to receive a refund of the price difference. ORDERS

If you are ordering on the Website, orders will be processed as follows: Once you have chosen a product, you may place this product in your shopping bag. You may then decide to continue shopping for other products and add them to your shopping bag (subject to availability and quantity limits) or proceed to “Checkout”. You may also remove one or several products you have selected from the Shopping Bag. These Conditions of Sale are applicable to any order placed through the Client Relations Center or the Website. If you refuse to accept these Conditions of Sale, you will not be able to order any Panerai products from the Website or the Client Relations Center. Sales concluded through Panerai authorized retailers or physical points of sale are not subject to these Conditions of Sale.

 

Your use of the Website is governed by our Terms of Use. PURCHASING ELIGIBILITY

PRODUCT AVAILABILITY; QUANTITY

All orders placed through on the Website are subject to availability and acceptance by Panerai. Quantity limits may apply in relation to certain products. Panerai further reserves the right to refuse at any moment in time, without prior notice, orders exceeding a certain number of authorized products.

In order to place an order, you or the Panerai Ambassador (on your behalf) may either register and create an online account, or place an order as a guest without creating an online account by selecting the "Guest Checkout" option.

ORDERS

If you are ordering on the Website, orders will be processed as follows: Once you have chosen a product, you may place this product in your shopping bag. You may then decide to continue shopping for other products and add them to your shopping bag (subject to availability and quantity limits) or proceed to “Checkout”. You may also remove one or several products you have selected from the Shopping Bag. Once on the payment page, review your order details and personal information (including email, shipping address, billing address and payment information), check the box next to “I have read and I accept the Conditions”. Then, place your order. Notwithstanding anything to the contrary provided for herein, Panerai reserves the right to refuse, cancel and terminate orders at any moment in time. For example, Panerai may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order or if Panerai suspects, in its sole discretion, that you have engaged in fraudulent or grey market activities or have otherwise violated these Conditions of Sale or the policies incorporated herein by reference.

PRICES, TAX AND SHIPPING COSTS

All prices shown on the product pages of the Website or quoted by the Client Relations Center are in Australian Dollars. Panerai reserves the right to modify prices and delivery costs at any time without prior notice. The price of and delivery costs displayed on the Website or quoted by the Client Relations Center, at the time Panerai provides you with a Confirmation of Order will be honored by Panerai. Actual shipping costs and applicable taxes will be reflected on your payment page before you are asked to confirm and place your order (in the case of a Website order) and will also be reflected in the Confirmation of Order. Delivery costs, if any, are described in the shipping policy set forth below and specified on the Website. Sales and use taxes will vary based on the location to which products are being shipped. Delivery costs and estimated sales and use taxes are not stated on the product pages but will be added to the product price, if applicable, after you have chosen your delivery location and options. Please note that changes to applicable law between the date your order is placed and the date you are sent a Confirmation of Order may result in changes to the sales tax associated with your purchase. PAYMENT

We accept the methods of payment offered on the Website or through the Client Relations Center. When ordering on the Website, you will need to enter your payment details on the appropriate form. In the case of an order placed by telephone, you will need to communicate to the Client Relations Center your credit/debit card number and your three or four digit security code that is printed on the back or the front of your card (CVV2/CVC2/CID).All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to Panerai, you will need to contact your card issuer directly to solve this problem. In order to process your order, we may perform security checks on your credit card. The full amount of your purchase will be blocked on your credit card until your order is shipped to the shipping address you have provided to Panerai, at which point in time you will be sent a Confirmation of Order and your credit card will be charged the applicable purchase price. By submitting an offer to purchase Panerai products on the Website or through the Client Relations Center, you expressly authorize Panerai to perform security checks, where Panerai deems necessary, to transmit or to obtain information (including any updated information)about you to or from third parties from time to time, including but not limited to your credit-card number, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorization and to authorize individual purchase transactions. PAYMENT BY BANK WIRE TRANSFER

Wire transfer payment is available through the Client Relations Center. All customers must provide proper form of identification when making a purchase by bank wire transfer. Panerai does not charge a fee for bank wire transfers; however, some financial institutions will charge a fee for using a bank wire transfer . Panerai requires that all bank wire transfer orders by phone be confirmed through an order approval process. Panerai may acknowledge a bank wire transfer order, but the order will not be processed until the payment has been received and confirmed by Panerai by email. If your wire transfer payment is not credited into our bank account within seven (7) days after you have placed your order, your order will be cancelled.

REVIEW AND CONFIRMATION

You should carefully check and confirm all details on the payment page before placing your order. In the case of an order being placed through the Client Relations Center, the Panerai Ambassador will verbally ask you to confirm the details of your order.

ACKNOWLEDGEMENT OF ORDER

Once you have made your choice and your order has been placed on the Website, you will receive an Acknowledgment of Order in writing (by email or otherwise), acknowledging the details of your order. Please make sure that you save this Order Reference Number for any future enquiries regarding your order. This Acknowledgment of Order is not an acceptance of your order. Following the transmission of the Acknowledgment of Order, Cartier will conduct its usual credit, anti-fraud, security and related legal checks and, if acceptable, will then process your order.

These Conditions of Sale will be provided to you with the Acknowledgement of Order. Please carefully review these Conditions of Sale upon receipt.

CONFIRMATION OF ORDER

Upon shipment of your order, following completion by Panerai of its anti-fraud, security and related legal checks, Panerai will send you in writing (by email or otherwise) a written Confirmation of Order. The Written Confirmation of Order constitutes the acceptance of your order by Panerai and indicates the existence of a binding sales contract.

PROOF OF AGREEMENT

The Acknowledgement of Order and Confirmation of Order that are sent to you are deemed to be received when you are able to access them. The Acknowledgment of Order, Confirmation of Order and any automatic recording systems used by the Client Relations Center or the Website will be proof of a binding agreement between you and Panerai.

COMPLIMENTARY SERVICES

Bracelet adjustment can be available on the material metal and ceramic. If you wish to have your bracelet adjusted, please provide the details on the Website or to the Client Relations Center.

SHIPPING POLICY

We only accept orders for delivery to addresses in Australia. Please note that Panerai does not ship to military or certain restricted areas, PO boxes, or hotels. If you order several products, Panerai will ship the order only once all products are available (no partial shipments). We will use commercially reasonable efforts to deliver the products, or to ensure the delivery by our third party shipping provider, on the estimated delivery date mentioned in your order. When estimating package delivery time, please allow time for credit approval, address verification and order processing. Please note that it is always subject to receiving your full payment.

DELIVERY

We will require a handwritten or electronic signature by you, or an adult acting on your behalf, to confirm the delivery of each Panerai product, at which point responsibility for your purchased goods passes to you.

INVOICES

When ordering products on the Website or Client Relations Center, you will receive, as the buyer, an invoice that will be sent to in writing (to your email address as a .pdf attachment or otherwise). You may also at anytime later request an invoice by calling the Client Relations Center. Panerai may request that you provide proper identification as a condition to comply with such request.

RETURN POLICY

In order to ensure your satisfaction, you may return Panerai products delivered in the country or countries listed in Clause 14, in accordance with the return and exchange policy set forth below. Returns of Panerai products that are not in compliance with the conditions and timeframes set forth below may be rejected by Panerai and will be sent back to you.

 


17.1. Return Period

Panerai allows you to return in the country or countries listed in Clause 14, Panerai products purchased on the Website or though the Client Relations Center within fourteen (14) days from the day you received your product, subject to the further terms and conditions set forth below.


 

17.2. Return Process

Panerai Products that have not been purchased on the Website or through the Client Relations Center may NOT be returned to the Panerai e-boutique distribution center. To return a product to the Panerai e-boutique distribution center, you must follow the steps mentioned below:

 

       i. Please, call the Client Relations Center (telephone number indicated on the Website) to agree on a pick-up date by our logistics partner VISA. You may be asked at this stage to provide photos of the product for us to make a first assessment of the condition of this product,

     ii. The Client Relations Center will send you a Return Form and pre-paid airway bill by email, after an initial assessment based on the photos of the product,

    iii. Please, fill out the required information on the Return Form and sign it,

    iv. You must include in the delivery package, the completed Return Form along with the product, all its accessories, the Service Guide, the Warranty Card and all other documents, in their original box,

     v. Please, seal the delivery package and affix the pre-paid airway bill outside it,

    vi. On the agreed date, VISA will pick-up the sealed delivery package.

 

You must keep a proof of return shipment, and Panerai accepts no liability in the event that such proof cannot be produced. Only merchandise received by the Panerai e-boutique distribution center will be eligible for a refund or exchange.


 

17.3. Condition of Returned Products

Panerai will verify that the returned product satisfies the conditions of the return policy and, if so, then proceed with the applicable refund or exchange. Panerai products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original Panerai box and delivery package, including all accessories and documents. Panerai will not accept any return if the product shows signs of wear, or has been used or altered from its original condition in any way.

 

Personalized products cannot be returned to Panerai for refund or exchange. This includes, without limitation, straps that have been adjusted.

 

If you have received free items as part of your order, they must be returned with the products. Watch bracelets that have been adjusted at your request must be returned with the exact same number of links as in the original delivery package. All returns will be subject to strict Quality Control (QC) by Panerai to ensure that the returned products satisfy these requirements. If the products do not meet QC standards, Panerai will refuse the return, and the products will be sent back to you. If the returned product satisfies Quality Control (QC), Panerai will proceed with the applicable refund or exchange. Failure to comply with the return process above or the return conditions will entitle Panerai to refuse the returned product and send it back to you, at your own cost.


 

17.4. Refunds

You may return a product purchased on the Website or through the Client Relations Center for refund, provided that the return complies with these Conditions of Sale. Should a product be returned to the Panerai e-boutique distribution center, only the buyer will be entitled to receive a refund of the purchase price. In no event will a person who has received the Panerai Product as a gift (i.e. a “the Gift Recipient”) be entitled to receive a refund. If the return complies with these Conditions of Sale, Panerai will use commercially reasonable efforts to refund the purchase price to the buyer using the same means of payment as used by the buyer for the initial transaction, within fourteen (14) days after receipt of the returned item by the Panerai e-boutique distribution center. Except for delivery of an originally defective product (as defined below), initial shipping charges will not be refunded.


 

17.5. Exchanges

You may return a product purchased on the Website or through the Client Relations Center for exchange with another Panerai product, provided that the return complies with these Conditions of Sale. In any event, the sale of the returned product will be cancelled and a new order for the product ordered must be placed. Should a product be returned to the Panerai e-boutique distribution center for exchange with a less expensive product, only the original buyer of the returned product will be entitled to receive a refund of the price difference. If a product is returned for exchange with a more expensive product, you will have to pay the price difference.

For any repair inquiries relating to a product ordered online, please contact our Client Relations Center (telephone number and email address indicated on the Website).

ACCURACY OF PRICING, PRODUCT DESCRIPTIONS

While Panerai endeavours to verify the accuracy of any information it places on the Website, in advertisements or catalogues or as provided by the Client Relations Center, to the extent permitted by law, it makes no guarantees, whether express or implied, in relation to the accuracy, reliability and completeness of such information. Panerai does not confirm the price of a Panerai product until an Order Confirmation has been issued by Panerai, indicating the existence of a binding sales contract. If a Panerai product’s correct price is higher than the price posted on our Website, then Panerai will either contact the Customer for instructions before shipping the order or, if Panerai cannot obtain your instructions, reject the order and notify you of such rejection. If the order is rejected and you have already paid for the product, you will receive a full refund.

FINAL PROVISIONS Information and complaints

To return a product to the Panerai e-boutique distribution center, you must follow the steps mentioned below:

      i)         Please, call the Client Relations Center (telephone number indicated on the Website) to agree on a pick-up date by our logistics partner Roadbull. You may be asked at this stage to provide photos of the product for us to make a first assessment of the condition of this product,

     ii)         The Client Relations Center will send you a Return Form and pre-paid airway bill by email, after an initial assessment based on the photos of the product,

    iii)         Please, fill out the required information on the Return Form and sign it,

    iv)         You must include in the delivery package, the completed Return Form along with the product, all its accessories, the Service Guide, the Warranty Card and all other documents, in their original box,

     v)         Please, seal the delivery package and affix the pre-paid airway bill outside it,

    vi)         On the agreed date, Roadbull will pick-up the sealed delivery package.

 

You must keep a proof of return shipment, and Panerai accepts no liability in the event that such proof cannot be produced. Only merchandise received by the Panerai e-boutique distribution center will be eligible for a refund or exchange.


 

17.3. Conditions of Returned Products

Panerai will verify that the returned product satisfies the conditions of the return policy and, if so, then proceed with the applicable refund or exchange. Panerai products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original Panerai box and delivery package, including all accessories and documents. Panerai will not accept any return if the product shows signs of wear, or has been used or altered from its original condition in any way.

  

Personalized products cannot be returned to Panerai for refund or exchange. This includes, without limitation, straps that have been adjusted.

 

If you have received free items as part of your order, they must be returned with the products. Watch bracelets that have been adjusted at your request must be returned with the exact same number of links as in the original delivery package. All returns will be subject to strict Quality Control (QC) by Panerai to ensure that the returned products satisfy these requirements. If the products do not meet QC standards, Panerai will refuse the return, and the products will be sent back to you. If the returned product satisfies Quality Control (QC), Panerai will proceed with the applicable refund or exchange. Failure to comply with the return process above or the return conditions will entitle Panerai to refuse the returned product and send it back to you, at your own cost.


 

17.4. Refunds

You may return a product purchased on the Website or through the Client Relations Center for refund, provided that the return complies with these Conditions of Sale. Should a product be returned to the Panerai e-boutique distribution center, only the buyer will be entitled to receive a refund of the purchase price. In no event will a person who has received the Panerai Product as a gift (i.e. a “Gift Recipient”) be entitled to receive a refund. If the return complies with these Conditions of Sale, Panerai will use commercially reasonable efforts to refund the purchase price to the buyer using the same means of payment as used by the buyer for the initial transaction, within fourteen (14) days after receipt of the returned item by the Panerai e-boutique distribution center. Except for delivery of an originally defective product (as defined below), initial shipping charges will not be refunded. Should a product be returned to a Panerai retail boutique, the individual making the return will only be entitled to receive boutique merchandise credit. No cash or credit card refunds will be issued in respect of a return to a Panerai retail boutique. Boutique merchandise credits can only be applied to products purchased in a Panerai retail boutique and cannot be applied to products purchased through the Website or Client Relations Center.


 

17.5. Exchanges

You may return a product purchased on the Website or through the Client Relations Center for exchange with another Panerai product, provided that the return complies with these Conditions of Sale.In any event, the sale of the returned product will be cancelled and a new order for the product ordered must be placed. Should a product be returned to the Panerai e-boutique distribution center for exchange with a less expensive product, only the original buyer of the returned product will be entitled to receive a refund of the price difference. Should a product be returned for exchange to a Panerai retail boutique for exchange with a less expensive product, the individual making the return will only be entitled to receive merchandise credit of the price difference. Boutique merchandise credits can only be applied to products purchased in a Panerai retail boutique and cannot be applied to products purchased through the Website or Client Relations Center. If a product is returned for exchange with a more expensive product, you will have to pay the price difference.

MANUFACTURER’S GUARANTEE

Panerai is extremely cautious in ensuring that each product strictly complies with our quality criteria and that it has passed all our controls, both technical and aesthetic. Selected products are covered by the Panerai International Guarantee. If you wish to repair a product covered by the Panerai International Guarantee, please refer to the Panerai International Guarantee, and call our Client Relations Center for more information.

If you receive a product that is covered by the Panerai International Guarantee and seems to have defects originally caused by Panerai (originally defective), please return it to Panerai in accordance with the return process above.

LEGAL GUARANTEE

In your capacity as consumer, you may have legal rights under applicable national legislation governing the sale of consumer goods; those legal rights are not affected by these Conditions of Sale.

REPAIRS

For any repair inquiries relating to a product ordered online, please contact our Client Relations Center (telephone number and email address indicated on the Website).

ACCURACY OF PRICING, PRODUCT DESCRIPTIONS

While Panerai endeavours to verify the accuracy of any information it places on the Website, in advertisements or catalogues or as provided by the Client Relations Center, it makes no guarantees, whether express or implied, in relation to the accuracy, reliability and completeness of such information. Panerai does not confirm the price of a Panerai product until an Order Confirmation has been issued by Panerai, indicating the existence of a binding sales contract. If a Panerai product’s correct price is higher than the price posted on our Website, then Panerai will either contact the Customer for instructions before shipping the order or, if Panerai cannot obtain your instructions, reject the order and notify you of such rejection. If the order is rejected and you have already paid for the product, you will receive a full refund.

FINAL PROVISIONS

Information and complaints. In case of any inquiry or complaint please contact our Client Relations Center on the telephone number and email address indicated on the Website.

Entire Agreement. The Conditions of Sale, including policies incorporated herein (e.g., Privacy Policy) constitute the entire agreement between you and Panerai regarding your purchase of Panerai products through the Client Relations Center or the Website, and supersede any prior conditions of sale.

Severability. In the event that any provision of the Conditions of Sale shall be determined to be partially void or unenforceable by any court having jurisdiction and for any reason whatsoever, it shall be void or unenforceable to that extent only and no further and the validity and enforceability of any of the other provisions of the Conditions of Sale shall not be affected.

GOVERNING LAW

These Conditions of Sale shall be governed by and construed in accordance with the laws of Singapore.

JURISDICTION

The courts of Singapore shall have exclusive jurisdiction over any disputes arising out of or in connection with these Conditions of Sale. Without any restriction to bring proceedings before a court, you and Panerai will first make reasonable efforts for a period of thirty (30) days to resolve amicably any dispute or failure to agree that may arise out of or relate to the product, the Conditions of Sale or any breach thereof.
